Ebay Fraud - Need help

Hi Fellow Dimers,
I have just been cheated big by a seller named android.curve1 on ebay, and now i seek your help. I bought this item – ASUS laptop K53SM worth 41K http://cgi.ebay.in/ws/eBayISAPI.dll?ViewItem&it... from him him but instead he sent me a completely different ASUS laptop X44L which is worth 28k only! and that too an open and a without bill piece. I have not confirmed item recieved on paisa pay yet but i have to in couple of days. Also, I have already case opened against him as per ebay process on 12 Jul but he hasn’t replied to me yet. I know this seller is a big cheat after going through his negative feedbacks (about 40 in last one month), and I know it’s my fault that i didnot see that before the transaction;and now that i am completely stuck , please help me what are my options now? And yes finally my advice never buy from ebay or from any online seller specially a costly item.

its better to call them tomorrow itself to know the details
first make a call.next put a mail the same both vendor and ebay customer care in loop …at least two mails a day..

You dont need his reply and all…ebay team will do the rest…contact them only via email so as to keep a record of every
conversation between you and ebay
I know this seller, he never picks up the call.
I had ordered a HDD but he sent me of a different make !
Totally unresponsive and unreliable.
but u don’t need to worry a bit, just raise a ebay guarantee claim from the link above ^ and you are done
just have some patience with ebay.. it takes time.
Thanks friends for your support, finally after almost one month got my refund approved today. Let’s hope that the money comes fast After this incident I am going to limit my online shopping and won’t be buying anything costly, it’s better to spend few extra bucks and buy it from a shop Peace of mind is important.

Sorry for replying late I am kinda moving of the city and bit here’s my account or ordeal if you might call:
1. It all started when I got that darn 10 percent coupon (An arose inside me)
2. I had my eyes set on a ASUS laptop K53SM-010 (which btw is probably best in it’s category) so I went to ebay and ask the seller if he can give me a bag as well, I will buy from him and not other (see more greed…)
3. I bought the laptop with CC payment around 24 of last June
4. No shipment details for about five days, so i mailed and he sent me the details. I checked the detail and the shipment was on it’s way. So, I was content, I thought everything was going as per plan.
5. In couple of days courier received, and then it happened opened the packing and see what? Wrong model! I was aghast and horrified.
6. So, I mailed the seller but no replies, I called him but he didn’t pick up, not even a call back.
7. I waited for two days and raised a ebay claim on 5th Jul (claim has to be replied in 7 days) as “item no described”, after that i read the whole ebay guarantee policy which thankfully looked like it favored the buyer.
8. Nothing happened for like five days, no contact from seller and nothing from ebay side neither.
I declined the paisa-payment (as per ebay policy, see sometime you should read policies and T&C )
So on fifth day itself I called the CC (as suggested by dimer here, Thnkyou ) and they sprung into action and called up the seller. Seller acknowledged his ‘mistake’ and got ready for replacement.
9. ebay claim department asked me to ship the item back in 5 days. Shiiping the item was challenge as nobody wanted to send such a costly item by courier, not even first-flight from which it came! Finally had to do
BlueDart, it costed me an epic 1550 bucks!
10. I emailed the scanned slips to ebay, they said they will reimburse me with coupons (again it’s policy!)
11. I called the seller and finally he picked up, I talked to him and went to his shop. He was not there, i said if he wants to resend then he should do the courier in front of me, otherwise i’ll not recieve it. He said come in the evening at07:30 when he send the couriers.
12. I called up in the evening at 06:30 saying that i was coming, he said he had to go home early today and would call me next day for sure. I said okay (and the call never came)
12. Next day item was received by the seller, and I called up ebay and asked for ‘refund’ only as i was really tired of following up the seller and i had this fear that he might do something wrong again. ebay guy said i’ll get a call back in 48 hours.
13. so i called up again after 48 hours, then CC said again 24 hours. I called again and reiterated my problem and asked for refund. So basically ebay guys kept on pushing/delaying without any call backs or replies to mail. So tired I just went mad at them, and started shouting and all. SO, the poor chap called up their floor manager and then that guy eplained that they already asked him for refund twice, and waiting for his reply, today is the deadline, if he doesn’t reply, we’ll approve your refund.
14. I prayed whole night that he doesnt reply.
15. Next day i got a call from CC (finally) that your refund is approved.
16. And yeah they said i’ll either get a DD or a cheque for 1550/- bucks, I am a happy and relieved man now
Lesson learnt: I am never gonna buy costly stuff from ebay now or from other site (flikart may be exception). It’s too much of a risk when you don’t know the intentions of the other guy, I guess it’s better to spend few extra bucks and buy the stuff offline. And btw finally i’ve struck an offline deal for that laptop for 38k and a bag (see offline deals can be good, you just have to pick up phone and call the sellers from justdial one by one)

For All Laptop deals u can go blindly to laptopplus shop if u really had one in ur area.by the way thanks for sharing ur experience

I also faced similar problems with seller clickbuy 5 months back. In my case he never shipped the item, never picked the phone call. He feeded a wrong AWB number to avoid automatic refunds. He replied to my mails once in 4 days. I got a refund from ebay after 10 days.
I also purchased a LG monitor from a seller which was not a good experience.
Ebay gaurantee sucks really… you do get you money back eventually but only after a lot of headaches and followups….

very true bhai..thats why selecting ebay seller is important..sellers like android curve waste time coupon and giv headache. took one month for refund for me because of android curve lol
call up the ebay toll free number and tell them why they are talking so much time to solve, also put a mail to ebay customer service now so that everything is in record
