STANDARD CLAUSES OF TERMS AND CONDITIONS:

This talktime rewards offer (the “offer”) is available on joining and successfully referring at least two or more than two users to join hike messenger services (“hike”), which is currently a free messaging service.
To earn talktime under the offer, you have to start using hike and also refer at least two persons to successfully start using hike. The offer includes a Rs 10 talktime reward to every user who joins hike and a Rs 20 talktime reward to every user for each successful referral. A successful referral entails a user inviting a user and the invited user joining hike and performing an activity on hike as requested by us. Redemption, however, will be enabled only after your total rewards balance reaches a minimum threshold of Rs 50. In case a user has been invited by more than one users, the referral reward of Rs 20 talktime will be given to the hike user who last invited the referred person before he joined.
A user can redeem only after accumulating a minimum reward of Rs 50 talktime, which will be redeemed subject to deduction of applicable taxes, duties and or levies just like a normal mobile recharge.
The redemption process following the accrual of the minimum reward threshold of Rs 50 talktime is as follows: “the user goes to the rewards option from the menu, enters the amount she/he wants to redeem, along with her/his account type, operator and circle. The user then clicks on ‘Redeem’ and her/his prepaid talktime balance will be recharged soon.” If the user has a postpaid account, the next bill amount of the user will be reduced by whatever amount she/he redeems. The user is required to ensure that she/he enters a valid talktime recharge for her/his operator and circle or the transaction might fail.
This offer is open for a limited period from 19/11/14 till 30/11/14 for subscribers of Hike Limited (the “Company”), who are also subscribers of operators in specific circles in the list detailed above.
This offer is being made purely on a “best effort” basis and participation of eligible users is voluntary.
Users can avail the services of hike without this offer too.
This offer shall also be bound by the terms and conditions of the usage of Hike messenger (http://hike.in…ms) as amended from time to time.
The decision of Hike Limited (the “Company”) in respect of all transactions under this offer shall be final and binding and no correspondence shall be entertained in this regard.
This offer is exclusive to any other offer run by the Company and is non-transferable. No substitution will be given nor any exchange or redemption for an equivalent cash amount or in any other form shall be allowed under any circumstances.
The Company shall not be responsible or liable for any failure, error, omission or delay in transmission of any messages or transactions in relation to the offer for any reason whatsoever. The decision as regards the receipt or non receipt of messages, or the success or failure of transactions shall solely lie with the Company and its partners and shall be treated as conclusive for all purposes.
The Company reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this offer or any part thereof at its sole discretion at anytime during it’s validity as may be required in view of business exigencies and/or changes by regulatory authority and/or statutory changes and shall be binding on the subscriber.
All services including the offer shall be availed by users in compliance with applicable laws and Hike reserves the right to withdraw its services including this offer to any user, who violates any law, violates these terms and conditions or attempts to commit any fraud in relation to the offer. The company’s decision will be final and binding in relation to violation of laws, terms, and any fraudulent activities. Fraudulent activities include, but are not limited to, trying to earn rewards by installing and activating the app on the same mobile number or device or on emulators.
The Company is neither responsible nor guarantees the quality of the services being offered as redemption nor is liable for any defect or deficiency of goods or services so obtained/availed, by the subscribers under this offer.
The prizes or benefits under the offer are neither assignable nor transferable under any circumstances.
All the prizes shall be subject to such other terms and conditions as may be applicable to specific prizes and shall have to be duly complied with by the winner.
The prizes to winners shall be given subject to compliance with all applicable statutory legislations/ processes /formalities in connection with the prizes and on production all such documents/papers as required by the Company before accepting the delivery of the prize. Any failure on the part of the winner/s to comply with directions issued by the Company for claim of prize shall entitle the Company to forfeit the prize/s.
All talktime rewards are subject to deduction of any applicable taxes, costs and /or levies and shall be exclusively borne by the subscriber.
The employees of the Company shall not be eligible for this offer.
Decision of the Company regarding all transactions under this offer shall be final and binding and no correspondence shall be entertained in this regard.
Participation in this offer shall be treated as unconditional acceptance by the participating subscriber to all the applicable terms and conditions.
This offer is subject to guidelines/directions issued by any relevant legal/statutory authority from time to time.
To the maximum extent permitted by applicable laws, under no circumstance shall the company, its directors, employees or agents be liable to any user for personal injury, or any special, incidental, indirect, punitive or consequential damages whatsoever, including, but not limited to, damages for loss of profits or revenues, goodwill, failure to transmit or receive any data, loss of confidential information, business interruption, loss of privacy, corruption or loss of data, failure to receive or backup the user’s data (or archived data), for any cause of action, including contract, tort (including negligence) or otherwise and any other loss whatsoever arising out of or in any way arising from or related to the offer, or following a failure, suspension or withdrawal of all or part of the offer at any time, any third party content, software or functions used in connection with the offer even if the Company or any or all of its agents have been advised of the possibility of such damages.
The user agrees to indemnify, defend and hold harmless the Company, its subsidiaries, affiliates and agents and each of their respective officers, directors, employees, successors and assigns from and against any claim, proceeding, loss, damage, liability, cost, demand or expense (including but not limited to attorney’s fees) of any kind arising out of: (i) any breach by the user of their obligations under these terms; (ii) User’s violation of the rights of a third party, including but not limited to infringement of any intellectual property, proprietary right or trade secret of any person or entity, or of any privacy or consumer protection right that is implicated herein; (iii) any violation of law or contractual obligation and any claims, demands, notices pursuant to such violation; (iv) User’s negligence or willful misconduct.
The Company shall not be liable to the user for any eventuality caused directly or indirectly by any act of God, wars (declared or undeclared), insurrections, acts of terrorism, acts of governments or boycotts, lockouts and other civil unrest, or any act of similar nature beyond the Company’s reasonable control.
Even if one or more provisions of these terms are held to be unenforceable under applicable law(s), the remainder of these terms shall be valid and enforceable.
These terms and conditions are governed by Indian Laws. All disputes arising out of this offer shall be subject to the jurisdiction of courts at New Delhi.
