OFFER TERMS AND CONDITIONS

• This is a promotional offer (“Offer”) provided and funded by Audible Singapore Private Limited (“Audible”), and made available on [ https://www.amaz...n/] and the corresponding mobile site and mobile application thereof (collectively, “Amazon.in”).

• These Offer terms and conditions (“Offer Terms”) are in addition to the Conditions of Use and Sale to which you agree by availing the membership of Audible (“Audible Terms”). To the extent, the Audible Terms are inconsistent with these Offer Terms; these Offer Terms will prevail with respect to the Offer only. Notwithstanding anything contained herein, Audible shall have the right to revoke the Offer at any time without any prior written notice in this regard.

• You may only avail this Offer if you: (a) are located in India; and (b) are 18 years or above. It is clarified that this Offer is not valid for existing members of Audible.

• This Offer will be available from 24th April – 15th May 2021. (“Offer Period”).

• During the Offer Period, any customer who successfully purchases any product on Amazon.in listed under Amazon Music Fest 2021 (“Eligible Products”) between 24th April to 26th April 2021 will be eligible to receive the Benefit as per these Offer Terms.

• Each such customer who fulfills the criteria mentioned in Section 5 above (each an “Eligible Customer”) will receive an Audible voucher code on their registered email by 7th May 2021, which can be redeemed on https://www.audible.in/promo/rede...on for an Audible membership of 3 (three) months without any cost (“Benefit”) Post the three month period, the Eligible Customers will move to paid Audible membership and charged INR 199/month.

• The applicable Benefit under this Offer will be activated and configured as part of the Audible account of the Eligible Customer at the time such customer signs up for the Audible membership during the Offer Period, subject to fulfillment of all the required steps.

• It is clarified that at the time of sign-up by the Eligible Customer, an amount of INR 2 will be deducted using the selected payment instrument by the customer, as a validation of such payment instrument. Such deduction of INR 2 shall be non-refundable.

• An Eligible Customer will be eligible to receive the Benefit under this Offer only once.

• There are no cash or other alternatives available in whole or in part, in relation to the Benefit under this Offer.

• All applicable taxes and levies in relation to the Offer, including without limitation sales tax, service tax, goods and services tax etc., shall be payable by you/ the Eligible Customer.

• Audible reserves the absolute right to withdraw and/or alter any of the terms and conditions of the Offer at any time without prior notice, and reserves the right to remove / withdraw this Offer from at any time and without any prior notice.

• This Offer cannot be combined with any other offer.

• Any queries in relation to the Offer and/ or the Benefit should be addressed at [Audible Support team.

• You are not bound in any manner to participate in or avail the Offer. This Offer is being made purely on a “best effort” basis and participating in or availing the Offer is voluntary. You shall not have any claim against Audible and/or Brand with respect to the same or with respect to any loss or damage whatsoever that you may suffer, directly or indirectly, in connection with this Offer and/ or the Benefit awarded hereunder or any information thereof

• By participating in this Offer, you will be deemed to have accepted these Offer Terms and expressly agree that: (a) Audible and/or Brand will not be liable or responsible for any loss or damage whatsoever that you may suffer, directly or indirectly, in connection with this Offer; and (b) Audible and/or Brand will not mediate any disputes or differences between you/ Eligible Customer and the Brand in relation to this Offer.

• These Offer Terms are governed by the laws of India. Any disputes arising out of and in connection with this Offer shall be subject to the exclusive jurisdiction of the courts of New Delhi only.
