PRELIMINARY

1. This Offer (defined in “Offer Details” section) is being run by Flashtech Retail & Xonight E-Commerce (“Seller”) on www.flipka...om, Flipkart Mobile App, Flipkart Lite Platform (all three collectively, “Platform”), which Platform is owned and operated by Flipkart Internet Private Limited (“Flipkart” , “We” or “Our”).
2. By participating in this Offer, user (“You”, “Your” or “Customer”) agrees to be bound by:
a. these terms and conditions (“T&C”); and
b. the Terms of Use, Privacy Policy and other relevant documentation including any modifications, alterations or updates thereof, that are published on the Platform; and
c. Terms and conditions of the Seller.

OFFER DETAILS

3. Offer is valid from: 10th September 2021 (00:00 hrs) to 14th September 2021 (23:59 hrs) (“Offer Period”) on KOTAK Credit Cards and Debit Cards.
4. On purchase of select OPPO Mobiles listed under Annexure A, sold by the Flashtech Retail & Xonight E-Commerce (Seller) on the Platform during the Offer Period, You will get extra 10% upto Rs. 1500 off.
5. To avail this Offer, You must do/ fulfil the following:
a. Age must be 18 years or above;
b. Must have a valid account on the Platform and log into the same;
c. Purchase of select OPPO mobiles sold by the Seller on the Platform (“Product(s)”) during the Offer Period using Your valid and currentKOTAK credit and debit cards.
6. Upon fulfilling the above requirements, You will get extra 10% upto Rs. 1500 off on the Product(s).
7. Discount on the Product will be applied at the time of checkout.
8. The Offer will not apply on payments made via the PhonePe payment container.

OTHER TERMS AND CONDITIONS
1. Offer not applicable to Card on delivery transactions, payments made through gift cards or any other transactions save for the Eligible Payment Method.
2. A maximum of 1 transaction per Customer can be made under this Offer.
3. Offer is applicable for EMI as well as Non-EMI transactions made usingKOTAK Credit Card , Debit card EMI Transactions only. Offer is not applicable on Debit Card Non-EMI Transactions.
4. Flipkart does not endorse the Products and will not accept any liability pertaining to the quality, merchantability, fitness, delivery or after sales service of the Products, which shall be at the sole liability and responsibility of the brand or the Sellers.
5. Pictures of Products shown in the communication sent either through mailers or displayed on the Platform, are representative only and may not bear a resemblance to the Products. None of the parties shall under any circumstances be responsible towards the same.
6. Sale of Products on the Platform is subject to availability with the Sellers, and accordingly Flipkart under no circumstances shall be liable for non-availability of any of the Products.
7. Flipkart shall not be liable for any failure by the Seller to honor the Offer terms. The Seller shall indemnify and hold Flipkart harmless against any claims by Customers in this regard.
8. Returned transactions, disputed or unauthorized/fraudulent transactions will not be considered for the Offer

9. Under no circumstances will the discount being offered under this Offer be settled with cash in lieu by Flipkart or the Seller.
10. Flipkart reserves the right to disqualify You from the benefits of the Offer, if any fraudulent activity is identified as being carried out for availing the benefits under the said Offer or otherwise.
11. Flipkart will not entertain any correspondence regarding the validity or acceptability of any additional benefits offered by the Seller and the same shall be at the sole risk and consequences of the Seller and without reference to Flipkart.
12. All government levies etc. shall be payable by You as applicable at the time the Offer was offered.
13. This Offer shall be subject to all applicable laws, rules and regulations which are in existence and which may be promulgated anytime by any statutory authority.
14. This Offer shall be governed in accordance with the applicable laws in India. Courts in Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this Offer.
15. You are not bound in any way to participate in the Offer. Any such participation is voluntary and the same is being made purely on a best effort basis.
16. Any query regarding the Offer will be entertained only till 10 days from the day of delivery of the Product. Post such date Flipkart or the Seller will not entertain any correspondence or communication regarding this Offer from any persons.
17. Flipkart or Seller reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary these T&C or to replace, wholly or in part, this Offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether.
18. Flipkart or the Seller shall not be liable for any failure by bank/ UPI facilitator to honor/ facilitate Your transaction or for any technical issues because of which the transaction made by You is unsuccessful.
19. Any disputes arising out of the Offer shall be subject to arbitration by a sole arbitrator to be appointed by the Seller for this purpose. The proceedings of the arbitration shall be conducted as per the provisions of Arbitration and Conciliation Act, 1996. The place of arbitration shall be at Bangalore for the Seller and language of arbitration shall be English. The existence of a dispute, if any, shall not constitute a claim against the Seller.
20. Flipkart shall not be liable with respect to the Products purchased.
21. You shall indemnify and hold Flipkart and the Seller harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney’s fee) that may be suffered by Flipkart or the Seller as a consequence of:
(i) Your violation of these T&C, or of the terms of use agreement, privacy policy (subject to change) as mentioned on the Platform;
(ii) Your violation of applicable laws; and
(iii) any action or inaction resulting in wilful misconduct or negligence on Your part.
22. This Offer is valid only in India. The minimum age of such a Cardholder shall be 18 years.
23. Further, as required by applicable law, if You make a purchase of an amount equal to or above Rs. 2,00,000, the Cardholder will be required to upload a scanned copy of his/her PAN card on the Platform, within 4 days of making the purchase, failing which, the purchase made by the Cardholder will be cancelled. The requirement to submit the PAN card arises only once and if it has been submitted once by the Cardholder, it need not be submitted again. The order of the Cardholder will be cancelled if there is a discrepancy between the name of the Cardholder and the name on the PAN Card.

24. This document is an electronic record in terms of Information Technology Act,2000 and the Rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Preliminary

1. This offer (“Offer”) is being run on www.flipka...om forOPPO Reno6 5G and Reno6 5G Pro (All Variant), Flipkart mobile app and Flipkart mobile site (collectively “Platform”), which Platform is owned and operated by Flipkart Internet Private Limited (“Flipkart”, “We” or “Our”). It is open to all residents of India holding a valid and current Citi bank Credit and Debit Cards (“Cardholder/you/your” and “Card”).
2. By participating in the Offer, Cardholder agrees to be bound by:
a. these terms and conditions (T&C);
b. the Terms of Use, Privacy Policy and other relevant documentation including any modifications, alterations or updates thereof, that are published on the Platform from time to time; and
C. all applicable terms and conditions of Citi bank.

Offer Details

1. The Offer will commence from 10th September 2021 (00:00 hrs) to 14th September 2021 (23:59 hrs) (offer period).
2. Under this Offer, Cardholders will get a Extra 10% Instant discount upto Rs.4000 off on transactions made using their Citi Bank credit, credit EMI & Debit card non-EMI transaction during the Offer Period, on purchase of Eligible Products (defined hereunder) sold on the Platform by the seller, XONIGHT E-Commerce . Offer is applicable only on one transaction per Card.
3. The discount will be applied to the Net Cart Value (“NCV”). NCV shall mean the total value of only the eligible product/s in the cart after all applicable discounts and exchange offer redemption
4. The Offer is applicable only on OPPO Reno6 5G and Reno6 5G Pro (All Variant).

1. All Cardholders, excluding Citi bank Corporate Credit Card, with no outstanding of more than 30 days are eligible for this Offer.
2. This Offer is also applicable on No Cost EMI transactions only on using a Credit & Debit Cards Card as per the terms of this Offer and is NOT applicable on transactions made through Internet Banking.
3. The Offer is not applicable for Card-on-delivery transactions.
4. In case of cancellation of your order, the transaction will not qualify for the Offer. If you cancel part of your order, you will qualify for the Offer only on the net amount you pay basis eligibility.

21. Flipkart or the seller(s) shall not be liable for any failure by Citi bank to honor the transaction and for any technical issues because of which the transaction made by the Cardholder was not successful. Citi bank shall indemnify and hold Flipkart and seller harmless against any claims by the Cardholder for unsuccessful completion of the transaction. Further, Citi bank shall solely be liable to the Cardholder for wrongful remittance of the amounts by it, without any reference to Flipkart.
22. By participating in this Offer you agree to be bound by these terms and conditions of the Offer, standard terms and conditions, terms of use, privacy policy (subject to change) of the Platform and the terms and conditions of the respective seller shall be applicable on the Cardholder.
23. The Cardholder shall indemnify and hold Flipkart, Citi bank and/ or seller(s) harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorneys fees) that may be suffered by Flipkart, Citi bank and/ or seller as a consequence of (i) violation of these terms and conditions, of the terms of user agreement, privacy policy (subject to change) published on the Platform, by Cardholder; (ii) violation of applicable laws by Cardholder; and (iii) any action or inaction resulting in willful misconduct or negligence on the part of the Cardholder.
24. All government Levies like Sales Tax, TDS, any Local Tax, Octroi etc., shall be payable by the Cardholder as applicable at the time of the respective Offer.
25. This Offer shall be subject to all applicable laws, rules and regulations which are in existence and which may be promulgated anytime by any statutory authority.
26. Any disputes arising out of the Offer shall be subject to arbitration by a sole arbitrator to be appointed by Citi bank for this purpose. The proceedings of the arbitration shall be conducted as per the provisions of Arbitration and Conciliation Act, 1996.
