Carpooling is illegal; Rs 10,000 challan implemented

The daily commuters residing in Bengaluru, who are already tormented by the alarming increase in traffic congestion in the city, are in for another shock. The transport department of Bengaluru has issued a circular, according to which using private vehicles for commercial purposes, such as carpooling apps like QuickRide and Zoom, has become illegal. Offenders in this case will face heavy penalties, including the suspension of the registration certificate of the vehicle involved or a fine of Rs 10,000 on the owner of the vehicle.

According to the circular issued by the transport department of Bengaluru, modern-day carpooling apps are breaking the law, as private vehicles cannot be used for commercial purposes, including the basic practice of carpooling. The action has been taken by the transport department of Bengaluru following repetitive complaints by taxi driver unions. As a result, the Regional Transport Offices (RTOs) of Bengaluru, including Electronic City, HSR Layout, Devenahalli, KR Pura, Jayanagar, and Yelahanka, have been directed to take action against the use of private vehicles for carpooling.

Public says they want Carpooling apps

However, the opinions of the general public of Bengaluru regarding carpooling apps differ from the transport department. According to them, using carpooling apps has made their daily commutes more convenient, helping them avoid heavy traffic jams, which have become a nuisance for the city’s residents. It also helps save money spent on daily commutes.

According to data released by the transport department of Bengaluru, there are currently more than 1.1 crore vehicles on the city’s roads, with 73.6 lakh being two-wheelers and 23.5 lakh being four-wheelers. Most of these vehicle owners are daily office-goers looking to ease their daily commutes, for which carpooling has emerged as an effective solution.

Apart from private companies, a few government agencies have also come forward to support the concept of carpooling. It will be interesting to see how the Karnataka government addresses this concern and develops a balanced policy.

It is voluntary to use this service, let the individual decide. It has lately become fashionable for the Government to ban anything.

And generalization cannot be made about the skills and experience of the driver. Some owners of cars can be more experienced, skilled and responsible whereas some commercial divers may be reckless!

For office goers especially, this won't stand probably a day if someone files a case against this order or challan. Simple reason, order says people can't use their private car for commercial purpose, which these people are anyway NOT doing!

They're only sharing fuel cost, and sharing fuel cost is NOT even remotely equal to running car for commercial purpose. Commercial purpose by definition means there is commercial interest, and the case of office goers, the car owners are not doing this at commercial scale, let alone making a livelihood out of that money. They have a completely different job from where they get salary for their livelihood.

So any such challans will be illegal and easily contested in court. RTO doesn't have the authority to randomly call any app as illegal, which is why they're not filing case on these app companies, but threatening common people who can be easily threatened in this country. If all these ride sharing etc is illegal then why the hell they don't file cases against these apps? If the things are really illegal, then their suppliers and supplying machinery can be banned, like p*rn websites can be banned but p*rn viewers are not arrested.

But do remember, this is all in context of daily office goers only, where car owners are also employees of some corporate companies and are only sharing fuel cost equally. This all is not true in case of white number plate cars who act as cabs between cities or even within cities but the car owner doesn't drive that car and also does not have his/her employer's office in the destination area.

How will they know whether someone is using a carpooling app? What if everyone just says they carpool without using apps?

Political game, it is good but I don't know why people are not registering it as commercial vehicle. Do we have to pay too much for commercial registration?

Arey kaahe ki vakaalat bhai... people in this country will pay 10000 fine rather than contesting that in court, because even a chhota mota lawyer is anyway going to take a lot more than that.
