FIR for Someone Not Returning my Money ? Need Help

So, Back in 2019 I purchased a phone for my office mate who was also senior than me on EMI.
Total Price was Rs.12000 and 3 EMI’s.
He paid me only one EMI and after that left company and never gave 2 EMI’s amount.
And even now he hasn’t paid me back remaining 8000 and keeps saying on call that he will give sometime in future.. but that date never comes.
Is there any way I can file a FIR against him?

OP should have taken some sort of guaranteed.
Plus why did he even had to finance a phone to his senior.
It’s already 3 years now. It’s not worth the hassle .

It’s almost 2021 gone so as ur money too,if fight legally u have to spend more so as last chance ask him to send as much money as he can even triple digit amount too…
I have a better idea.
OP should tag his senior, his current co workers and even is company on LinkedIn and copy paste the issue with proof.
I am sure he’ll recover the money 🤑.
If i were him, i peg down krke kar deta mai kab ka.
Find his current address.. take 2-3 friends and threaten him. That’s the most you can do try to get your money back .
If his senior complains to the police, then it will be far more trouble for OP 😂

I think there is limitation period of 3 years applicable on loan/recovery of money. Means you need to file suit before expiry of 3 years from contract. Otherwise you cannot claim money legally.
3 years from the due date, that too in case of written (or any other form which can be proved to have existed) contracts, no law applies in the current case.
Police can still help you through pressure tactics if you know some police officer (At a personal level)
I have learnt from my personal experiences that :
Never Trust any other person to pay you EMIs, except the person matters to you so much that you can let it go, if not paid.
Your type of people made the Govt. make their mind to ban crypto trading. Some people just don’t understand the risk word at all, start asking for a legal way to deal with their own stupidity.

Find address and visit house repeatedly if possible
or forget and move on; it happens to almost everyone so take it easy

if someone’s cheque bounces then that case is eligible for fir under section 420(char sau bees kidhar se aaya Pata chala 😉)
Tell him to pay little amount each month instead of paying all at once. One of my friends didn’t return 15k for several years, even I had forgotten about it. He reminded me, lol. I asked him to pay at least 1k a month if he cannot pay more than that. He finally sent some money.
you have proof of mobile purchase so go and file FIR for stolen
tell the Police who holds the handset now and mobile number of the person
ask the mobile operator to block IMEI (not sure it they do such a thing)
Police complaint kardo ki someone stole your phone and give the phone’s imei .

Same situation but i orderd phone on my Name with my address, when my colleague not paid amount of emi, and leave job, that time i just warning, bill is and box with me and also on my name so if you not paid amount I just complaint police, you theift my mobile and and leave job, after that he paid full amount. So tack backup plan for this kind.
Yeah, even i have my name and address on the phone bill.
I learnt a lesson in childhood itself. Paid Rs.10 for a friend in School when I was 8 yrs old and he never gave back. That’s it, that was the day. So in my whole life till now the only money someone duped me of Rs.10. After that it was clear to all my friends that friendship will be there but no kind of financial txn will happen. I won’t ask them for money and won’t let them ask. Paisa chahiye toh dost dusra banayiye. Apne saath har type ki help mil sakti hai except money.
Reminds me of the mastercard slogan - There are some things money (read — friends) can’t buy (read — help), for everything else there’s mastercard (read — bank / financial institution).
kuch likhit me tha to it will take 2-5 years easily in court, harassement extra. if not written then nothing can be done. duniya badi gandi ha dost.
