In a clampdown on goods coming through e-commerce portals using the “gift” route, the government on Thursday prohibited such imports except life saving drugs and rakhi. The import of gifts was earlier free and not subject to customs duty.

The move will impact Chinese e-commerce websites like Club Factory, Ali Express and Shein who are the largest users of this route.

Import of goods as gifts with payment of full applicable duties is allowed,DGFT said in a notification on Thursday.

The government was concerned over a large number of products from China entering India as ‘gifts’ and being shipped directly to customers since gifts of up to Rs 5,000 intended for personal use are exempt from customs duties. Moreover, this was hurting the Make in India ambition as New Delhi’s trade deficit with Beijing in 2018-19 was a whopping $53.6 billion.

ET had reported last year in December that the Department for Promotion of Industry and Internal Trade (then called department of industrial policy and promotion) wanted to impose restrictions on such online purchases of “gifts” from Chinese etailers and apps.
The Indian industry had complained to the government that Chinese etailers are taking undue advantage of the exemption from customs duties on gifts of up to Rs 5,000. Moreover, Chinese etailers, unlike their counterparts from other countries, do not ask customers for any government-issued identity proofs to complete the transaction, making it difficult to track such transactions.
As per the notification, import of goods including those purchased from e-commerce portals through post or courier where customs clearance is sought as gifts, is prohibited except for life saving drugs/medicines and Rakhi (but not gifts related to Rakhi).

“Earlier, there was no duty on such gifts and Chinese websites were misusing this gift arbitrage the most. Now they will have to pay customs duty,” said an expert.
In case of rakhi, no duty will be collected if the amount of duty leviable is equal to or less than Rs 100.

Most of the shipments..don’t get marked as gifts (by the sellers) unless you specifically request them to do so
They just undervalue (most cases) like 5$ for a 20$ item and if the package size is small..these lazy officials don’t even bother to open it
If this becomes a new rule (not sure if its already in place) then they take a month or two (Doubt they have the tech n qualified professionals to classify ecom shipments from personal shipments) clear shipments (which is taking about 3 weeks now in blr) and start charging like what Traffic police did post the new traffic rules

So what does it actually mean if the shipment coming is genuinely priced less than 2-3k & not marked as gift.If I am understanding correctly,such packages will take longer time to deliver now & will also have to pay customs duty of ~30%.

Means regardless of the price declared..u will end up paying 45%+GST
And they will start considering every package from china as ecom shipment so clearance will take a lot of time.

Till date..i think they’ve intentionally let go those small packages worth 4/5$ unless they find something odd about the package contents (like Watch, router, graphics card, cpu …). In such cases, they hold the package and update the tracking something like “Improper documentation” or something relatable. This means sure shot customs but how much depends on your communication with them (Mail to respective city customs with purchase proof and bank statement)

About the time taken to deliver..it completely depends on the city where they assess customs value. Here in Bangalore, there are taking almost 3 weeks now (could be because of the 11/11 rush) and not all packages get charged extra customs (Received two shipments via sing post with zero customs even after being stuck with Bangalore customs for 3 weeks).

Yes it would generate employment and bring fdi and all.
When i was taught customs, there were specfic case studies, saying how people use this route to evade customs.
The actual thing is only small customers like us would suffer. People who buy in bulk (business people) will find another ways to evade this again.

Received 4 orders via China & Sing Post in the past two weeks. No extra duties levied/Paid
Two of them were undervalued & the other two were marked as gifts ( Mentioned prices were about 15-35$)

I also received two products recently. But i ordered them well before the annoucement date, so maybe they might have cleared customs already.
