Help - renter has not paid for 6 1/2 months and refuses to get out!

A renter has been creating huge problems for my parents. He and his family are not poor ppl, 2 of their family has jobs and kids are studying in private school and college!
But they have stopped paying rents for 6 and half months + excessive electricity bills!
They had even chased out the renter next door and chases away any ppl who come to see.
3 days back, he had even verbally abused my mom and me.. dad doesn’t want to go to police but I wanted to.
Is there any legal way to evict them out by the end of this month?

Any rent agreement signed by both ?! U still hold their advance with yu right ?! Why are they not paying rents suddenly ?! Were they paying before ?! Also legal system takes so much time and cannot be done immediately as I have seen these cases happened for my frnds family as well

We had made agreements b4 but ONLY this time, my dad forgot to made agreement with :/
Had 2 months advance but used up.
They are entering 1 year. For 5 months they paid then suddenly stopped, saying they had financial problem but now we met other ppl (renters) who knows them said they do this sh*t to wherever they stayed and end up running away with paying bills for 2-5 years.
The last landlord had evicted them by selling the land to builders ☹
P.S they don’t have financial difficulties. Just celebrated a big anniversary party 2 months back 😑

Have you installed a separate electric meter for the tenant?
If yes, then don’t pay the bill. What he would do without electricity.

As there is no rent agreement, you don’t have any options. But you can consult a Civil lawyer.

Tenants need to be put on notice that late rent will get them a 7 – day notice to quit premises from the Police, or however it works in your locality. The problem with late rent, is that rent is often their biggest bill. If they can’t produce one month’s rent now, what are the chances that they will come up with two month’s rent in a few weeks? People who fall behind on rent have a very hard time catching up. They need to understand that rent comes first: before cable, before car payment, before credit cards, before the phone bill… pay the rent on time, or be homeless.

I have faced a similar problem in past and it took 5 years to evict the tenant… somewhere it was my mistake too as hired a wrong advocate….but don’t fear just approach a good lawyer and send them a notice to evict the house within 1 month or tell the lawyer to show them as a trespasser as they also don’t have a copy of agreement

Nothing will happen unless you make a police complaint. Preferably give complaint in women’s police station. Try to record any audio when they are denying the rental payments.

go to electricity dept n ask them to disconnect their meter.
also if there r other utilities connected to their house like water,gas etc. get it disconnected/blocked.

Tenants bina rent ke b rehte hai.. Nvr experienced this.. U should make efforts from the month when they stopped paying u rent… Don’t do anything extra… Just hire a lawyer and send notice… U don’t need to go further…. And someone in ur relation may know a lawyer atleast… Even a newbie will work..

Hahahah..after reading all the comments of the fellow dimers…I had a big laugh…no kidding…property matters are not solved this way guys….apologies if i m rude…

…disconnect the meter they will buy private electricity…disconnect water supply they will dig a big bore well…I mean i personally know these things….if you try to be extra smart like threats or fist fight they will file a case of rape or harassment….. single FIR against govt job guy or good private sector guy means loss of jobs….they will cook up any story.

… The recent example I saw in Delhi in my neighborhood…owner tried everything…electricity, water…even blocked the entry exit point….the tenant filed 11 cases against the owner….including rape, criminal intimidation, 17 lakh rs debt on the owner (that was tenants original asking price for vacating the place ). Tenant said that the owner took 17 lakhs from me 2 months back and now not returning so i will stay here till he gives my money back…. stuck_out_tongue

… Police knew it but everything has a price….even the tone of the fir… Instead of tenant-owner rent discord or possession thing they mentioned financial disagreement and enjoyed the fight….
…It’s been 3 months now…court case has started but it will go on for 3-15 years….only reason was the owners greed for not renewing rent agreement….owner wanted to save 2000-3000 rs….uncle scrooge.

My advice… If your tenant is professional which i believe he is then go for out of court settlement….and whenever he calls you for talk…bring ladies with you and a camera….

That’s why legal agreement is always needed, i have saw many cases how so sweet tenants turns greedy 1 in my family and 1 in my neighborhood. Just call your all family members approx 20-30 members you have if i am right from mothers and fathers side and go at once all of you to talk to him, once in my neighborhood same case his happening when all the neighbors and his family members collectively go to him he got feared by seeing 30-40 peoples together and left within a month though he is leaving from 5 years and abusing and not leaving. Unity is strength and make sure if your family goes to talk to him one is holding good camera and everything is recording and he once abuse someone he is gone , someone can use it as warning for him that defaming case can be filled against him if he not left within 15 days.

I think the best possible way is to use
A mix of legal and illegal system.
As suggested by someone find some source in police department even the one retired 7 year ago will have good links and use them and sadly if required bribe them too.

This is why you only rent for 11 months and always go through broker, brokers have enough resources to kick tenants if they dont pay, but indians will always think about saving small amount of money and then loose a big amount

Brokers are only here to sell or buy land and flats. That’s it.

I think you are fearing more than the tentants “Police Complain Case toh nahi ban jayega”
If you are not strong in your approach, they will see this and use this in your advantage.

File a court case, send the copy of case letter to them or else bear the looses.
Selling land is not always the option.
As you said they already did this because they are experienced in this.
May be they are owning property and rented them to earn, they are renting your property just to use your services and skip the rent.

Had it happened to me, I would have gone nuts. It’s your house, go in and throw there stuff out on road or gutter literally. Fk rent agreement, fk police, fk court. It doesn’t matter if they have money or not, they ain’t paying, drag there sorry asses out.

TRY AT YOUR OWN RISK

May be send them a legal notice, staying if you dont vacant your house, i will take the belongings to cover my losses.
Send them a formal letter, saying if you dont hear any response from them/rent payment you will take away the belongings by this day give alteast 20 days.
Also convey the same 5 days prior in 1-1 meeting and video record it as a proof.
Wait for 15 days more from the day of seizing the property and them seize there property/create scene near the area, if police comes no problem considering the notice and the video recording you have.
