Hershey's Sued In US After Study Found Heavy Metals In Its Dark Chocolate

Lead levels were particularly high in Hershey's Special Dark and Lily's 70 percent bars, while levels of lead and cadmium were particularly high in Lily's 85 percent bar, the BBC states.

In his claim, Mr Lazazzaro contends that he would not have chosen to pay less for the bars of Hershey's Special Dark Mildly Sweet Chocolate, Lily's Extra Dark Chocolate 70 percent Cocoa, and Lily's Extreme Dark Chocolate. Lead poisoning can result in a number of health issues, including anaemia and frailty. Lead poisoning can harm the kidneys and the brain. According to the Centers for Disease Control and Prevention, children exposed to lead run the risk of developing learning and behavioural problems, as well as harm to the brain and neurological system.

Hershey didn't get Sued there because one/few of their chocolate variants got lead and cadmium in them (The same metals are found in certain fruits & vegetables too). This happened because the brand failed to mention this info on the product packaging 

There are no federal lead and cadmium limits for most foods. Consumer Reports scientists used California standards, as they deemed them “the most protective available”. The report said lead content in the Hershey Special Dark Mildly Sweet Chocolate bar exceeded the California MADL.

The suit contends that consumers look to product packaging and labels before making a purchase. It alleges that Hershey’s advertising and marketing are “false, deceptive and misleading” because they do not disclose the alleged high levels of lead and cadmium.

FYI, US allows the use of food additives/preservatives which are banned in many other countries. So, it all depends on the food regulation agencies and the users consuming products understanding the risks
