Hi ,
I have outright purchased a new flat in 2021 April from its first owner ,
On the day of registration , I did not get my sale deed stamp papers from court , I thought it may take few-day for court to handover sale deed to the NEW buyer , Due to some sudden family issue I forgot to follow up with the lawyer and this thing entirely skipped my mind .
today I was searching for something and suddenly I had thought whereabouts of my newly purchased flat sale deed . I clearly recalled that the lawyer did not give my original stamp paper sale deed. The lawyer is now blaming me for not collecting the papers from him and claiming that I have taken the original paper from him which is not the case at all. he said court had given him a token and few-days he showed the token and collected the paper and handed it over to me . Don't know why he is making this story .
I and family members thoroughly checked my home but did not find this sale deed . Also when I check my call records and call history , I did not even talk to that lawyer after our registration date ,don't know whom he had given my papers.
My questions
1. How to stop misusing my original paper by others or by that lawyer ?
2. Not having the original paper will surely affect my re-sell value , how to avoid this ? what extra document should I keep to show future buyers along with certified copy ?

file an FIR and apply for certified copy and resale value will be less if paper are not orginal

@ZitOO, Are you paying municipal taxes for the property? If yes, you have atleast some documents to claim that you are owner.

Ask lawyer and file a missing complaint. There may be some charges but i am sure court may reissue certificate. Just file an FIR or ask lawyer to file missing/lost complaint.

will do that today . he is in no mood to search my document , easy for him to to claim that he had given me the original deed .
My only issue is convincing future buyers the reason for not having original sale deed with me . 😌
Certified copy will not work for sure .
When I check various advocates suggestions .
They advise to seller , not to worry and get certified copy from sub register office which will be as good as original .
on the other hand , same advocates advise buyers not to deal with any property for which owner lost original papers .

As they say FIR must be filed by owner himself .
But If I file FIR or complaint , I will surely state the actual incident . that my advocate did not give me original copy ..

That would be biggest financial loss for me . I know buyers will be reluctant purchasing my flat .
Some would take advantage of this and would quote very lesser price .
Certified copy wont be as good as orginal paper in eyes of buyer.
My only resort is to get certified copy + FIR + Non traceable report + newspaper publication .
but even after all these price of property would be very less than the market price 😞

/series/chain documents would be needed, the original title deed from 1st owner is also not with me . title deed and sale deed are with that advocate.
bank would definitely ask for original sale along with my new gift deed.
thinking to sale this property after 2 year . if no buyer ready to buy then I would get any other choice but rent my flat .
would collect all needed documents (FIR+newspaper+CC) and get a mortgage loan of 60% of property value from bank at 10% interest .
only problem is rent , which is not enough to repay the loan emi .

Bro I Think You Get It From Your Lawyer If He Have Save In His Pc If Not Then You Get It From Court Or Sub-registrar Or From Their Official Website

Main reason to buy this flat is to add a extension to our existing 3bhk flat , parents stay in that flat . buying a adjacent flat is to give them their privacy and not staying far away from them .
Maa and wife now started hating apartment rules and regulation . that we can not do this and that . Can not keep flower pot on terrace, guests can not park their car inside and others .
So already booked a villa where we get a personal garden and personal terrace. so that they can fulfil their plantation and decorate their home outside as per their wish 🙂. villa will be delivered after 2025 only . may be mid of 2026 .
Though apartment location is nice , new apartment buildings are under construction right left of our building . new apartment rates are high around 6000/sqft . When we buy our 3 bhk flat in 2015 , it was just 2400 per sqft. our flat is at 1st floor. I will keep it if I get good rental income . Currently rental income is too less as compared to bank interest rate . its just 3% per annum. appreciation in flat value is very difficult unless area become a hot-spot in coming years.

We have gone through most of the things here.
It was factory document and had been misplaced. We filed FIR and got the attested certificate-. Let me say, it is not easy getting FIR. Had to Bribe Police as well as got few items for Police Station. Then had to run behind Tahsildar/Village officer since plot was in village; had to bribe to get his signature (needed for filing FIR).
After getting the documents, Buyer refused to buy the property citing Certified Documents. Gifted it to my spouse but still the buyer rejected the property saying the property was unlucky! as it took nearly 7 months to get the FIR and Documentation Done. Said it was not 'raasi' to him.
