Need help regarding two wheeler purchased online

Hey guys need some clarity on my cousin who booked chetak 2901 electric via Amazon and was given expected to be delivered by 21st Aug. He completed all documentation by 31 st july and paid for rto -accessories -tec pac etc but didn't paid insurance because the battery coverage under insurance didn't have clear t & c from bajaj alianz insurance
Then the insurance company shared t & c and then he paid insurance fees on 10th august but the insurance wasn't processed despite followup till 19th august and insurance was sent on email dated 19th August.
He gave stern warning to dealership that finish the process and deliver the vehicle on time by 21st August but the dealership and their sales executive didn't bother to complete registration giving some lame reason till 23rd And my brother fed up of this decided to file a complaint with Amazon bit Amazon cc denied saying they don't have a option to raise a complaint as deliver has updated as out for delivery on 23rd and could only take complaint post 3days .... So he wrote the email to Grievance Redressal and didn't got any reply so he decided to wait for 3 days as it was holiday too
Today morning he was able to file a complaint with Amazon under a-z guarantee for refund but the seller is calling him incessantly and saying vehicle is registered and ready for delivery but he clearly told them he doesn't intend to take the delivery as you missed the deadline despite Fulfilling kyc & payment days in advance and done follow up every day. So i am not comfortable taking the vehicle & he is ready to wait for refund
But the dealership is saying we have registered the vehicle so we can't cancel the order but on asking for details of registration they gave some reason without sharing any details.... Then there was no sms from vahan too post aadhaar otp for upload
So what's the choice here, I am confused to advice him
Dimers especially someone well versed in law and mva could you help me what can be done
Can he deny delivery and get refund or he need to take the vehicle or he should file a consumer forum complaint
Please guide me

If you need vehicle, take delivery (3-4days delays can happen/proved ) , it won't go in your favour.
Other than that if you have decided to take refund, raise charge back on payments made.
Registration of vehicle happen after you sign n submit following:
- Form 20 duly filled up.
- Form 21 (Sale certificate) issued by the vehicle dealer.
- Form 22 (Road worthiness certificate) issued by the which manufacturer.
- Self Attested copy of valid vehicle insurance policy/covernote.
Refund will be time consuming process.

But even after 1 month of booking and 20+ days of documentation how is that fair, if it was vehicle availability issue or kyc related issue one would understand... This is sheer negligence by dealership and thier staff as vehicle was showed as shipped and was also informed as alloted way back on 3rd August now why it needs 20days to register
Think wise act accordingly. Your friend seems to be offended for delay in delivery, but need to matain his cool at these situations. Refund will be less of what RTO charges and insurance. As the dealer will claim he paid already and as per policy not refunded. So big loss, better take delivery keeping his ego aside.
How is he at fault -finished kyc -paid everything -waited &even follow up was honestly done you're just blaming him for no reason

Don't back down, this "Chalta Hai" attitude is the reason why things don't improve in this country. Bajaj is corrupt, it seems Bajaj Auto is following in the footsteps of Bajaj Finserv. If you are not provided with a satisfactory resolution, besides filing a consumer forum complaint, consult a lawyer & slam a mental harassment case as well.
Yes my brother is in the thought process but given what I have heard here & on Teambhp and electric vehicle forums the practically it's not in our favour to fight and get justice even here as @HasdaChehra told the act for enforcement of contracts goes back to 1875 god only knows what those colonial implications we have to follow even in 2024
Many like @playdime are saying that's normal to be delayed and were eligible for tantrums and delays despite honest effort to pay -fulfill all conditionsi am not hopeful of getting better treatment from them for my brother but atleast there is someone who has sone grit to fight and there are some like @Gulag-Survivor to support that's a last bit of positive
Amazon has become pathetic for customer service I had placed 2 orders on 6th August they clubbed the orders and showed delivery date 11th August. As order was not delivered on 11th next day I contacted Amazon Cc they told me I will get it by 14th. Order was not delivered that day also so again contacted them on 15th they asked me to wait by 17th or else refund would be issued. On 19th again I contacted them for refund they told me that refund would be issued when the product reaches back to the seller on insisting time line they told me its 11days from expected delivery date plus 5 days. Till now refund for 3 items has been issued and waiting for remaining 2 items even though 3 items were same. I have stopped contacting them and waiting till end of the month to file a case against them.
Raising complaint to rbi ombudsman or nodal officcer if Amazon pay??
Chetak service and range is pathetic, suggest you test drive Ola Gen 2 before buying again and if you can wait then Ola Gen 3 which will be launched in first half of next year.
I too had booked Chetak but cancelled it after feedback from sister who owns it.
Ola was Never in my options due to negative comments everywhere but when I test drove it, I instantly fell in love and a Big Plus was affordability and range.
Guys Amazon has today confirmed processing refund

Now the dealership manager and bajaj South sales head spoke and apologized and requested to take delivery of the vehicle and can also give assurance of vehicle in good condition in writing -Delivery at my location and can give Compensation too (not limited to accessories or freebies)
And also can give in writing that they are fully at responsibility of this whole mess of delaying the process
My brother clearly denied taking delivery..... They requested to reconsider decision and think through will get back to you by tomorrow
If still not okay to take delivery they're ready to give full refund
I think if you won't take delivery they will surely cheat any other buyer by getting the vehicle transferred to his name. They won't tell him about previous registration and get it transferred to his name if cancellation of RC cannot be done. My suggestion is if your brother really want to buy he should take the deal as what is the benefit of going through all the formalities again?
@jioanupt -- Well, I ignored this thread as I thought it was regarding buying a two wheeler online!!
Everything said and done, I feel you (your brother) should go ahead with dealership managers offer if,
- He is still interested in buying the same brand/model two wheeler.
- The dealership also takes care of service.
The whole episode will help ease out any further situation with regards to after sales service.
How could one be comfortable after all this issue with the dealership.... Even if we take the vehicle at any instance we're never going to be comfortable riding it given the long bad feeling associated with the purchase
And i am damn sure we would not step a foot in thier service station at any instance atleast that's the thought.....
Sorry to say that but in my family we buy vehicles every three months or so ( extended large family) ranging from 2 wheelers -suv -mpvs -Atvs and we clearly are aware of how RTO & dealership works..... In fact my brother has a atlas 15 lakh milestone finished using these purchases for two years..... Previously it was magnus..... He is like every month looking to buy new one for someone or the other..... So his experience and thinking is what we all respect... We can't argue with him. So his decision is final
GOT FULL REFUND from Amazon -Dealership agreed to Refund FULL amount but still requesting to take the vehicle delivery..... My brother has denied but they persisted so my brother has put a condition if they could provide in writing that they wouldn't CHARGE any extra charges to all Customers on digital payments including credit cards across thier services ( they have 2 wheeler -ev -three wheeler -agri equipment-commercial vehicle dealership)- and Also should not deny Digital payments he can take delivery..... obviously not going to be met but still they took it to management for the condition appraisal...... Waiting for thier reply

I have heard prices of all models of Chetak gonna make downward curve soon as new models are lining up with better range.
Also inventory with dealers touching all time high, supply of vehicles in surplus demand competitively lower.
