Strange things without any rational basis can happen in a nation of 128 crore people. Now, Arvind Kejriwal is projected as an “honest and different politician” who fights evil. Only when the electronic media calm down will his real face emerge.


Consider how he got out of government service. While serving as a Joint Commissioner in the Revenue Department (Income Tax) under the Finance Ministry, he went on a sabbatical (paid leave) from November 1, 2000 to October 31, 2002, and went abroad. One condition for such leave is that the employee must serve continuously for at least three years after return, failing which he or she must pay back the salary he drew over two years with penalty.


There is a bond to be executed, with witnesses and guarantors. Mr. Kejriwal re-joined duty on November 1, 2002 but at once went on 18 months’ leave without pay: he did not serve continuously. He resigned in February 2006. As he had jumped bond, his resignation was not accepted.


The Income Tax Department sent him a notice in 2007 and again in 2008 asking him to pay up. Mr. Kejriwal, who was by then appearing on TV almost every day, expected the government to budge. He said the government could deduct the dues from his retirement benefits; as he had done no wrong, his dues must be waived. After sending a notice on August 5, the department sent another in September asking him to pay up before October 27, 2011 — failing which he would not be relieved and he would not get his retirement benefits.


Attachment of his property and criminal action could follow. Mr. Kejriwal termed it an attempt to create obstacles to his agitation against corruption. When he did not respond by October 27, the department asked his guarantors to pay. Mr. Kejriwal pleaded his friends should not be disturbed. When it became clear the government would initiate proceedings, he announced on October 30, 2011 that he would borrow from his friends and pay the dues of Rs.9.28 lakh. He wrote to Prime Minister Manmohan Singh on November 3, 2011 enclosing the cheque.


Certain things tend to be forgotten amid the din. An impression has been created that the Aam Aadmi Party enjoys the support of 2.2 crore Delhiites. It got only 29 per cent of the votes. That means 71 per cent of voters rejected it.

The AAP laid 18 conditions to get Congress support, some of them mere administrative actions like removing red beacons from vehicles. He said he had written to the BJP and the Congress on these, and once he got replies he would go to the people and ask them what to do. However, the Congress did not accept the conditions. Yet, the AAP formed the government with Congress support.


It is doubtful whether the schemes announced by AAP can be implemented. The Delhi government has a deficit of Rs.1,725 crore. After announcing a 50 per cent reduction in power tariff, he announced it was only under consideration. He had asked people not to pay power bills. Many did not, and faced power theft cases. If Mr. Kejriwal withdraws the cases that would be a bad precedent; no court will permit that. If he does not, his followers will feel victimised. While he promised 700 litres of water per capita, residents in many areas now beg for at least 20 litres. Only 68 per cent of households have piped water supply.


Mr. Kejriwal is known for his sensational announcements. During a first round of fasting action, he said he would expose corruption by 15 Union Ministers. In December 2013 he said he had proof to show five Ministers had Swiss bank accounts. He said in November 2012 the Central government had a list of 700 Indians who had stashed money in HSBC Bank in Geneva, and demanded that foreign banks give all the names to the government; he asked HSBC Bank’s staff members in India to resign.


The most popular of his stunts was restoring power connections severed for non-payment as he felt the tariff was high. As cameramen clicked away, with a pair of cutting pliers he connected the wires on June 27, 2013. Although it was an offence under the Electricity Act, the electricity authorities did not act fearing his TV-based backing. He chose to take law into his hands, sending a message that he did not believe in a democratic way of functioning. This is in tune with his other activities like offering dharna in front of the Prime Minister’s house, violating orders under Section 144.


What Mr. Kejriwal has done, has been done by so many other politicians. Prashant Bhushan of the AAP wanted a referendum held in Kashmir to determine people’s opinion on the presence of the Army. Mr. Kejriwal said it was Mr. Bhushan’s personal opinion but the consent of local citizens must be ascertained. But there is no difference between a referendum and getting people’s consent. On January 12, Mr. Bhushan said the police must be withdrawn from Naxalite-hit areas.


Mr. Kejriwal is yet another politician who has resorted to politics as his last refuge. I wonder if Meera Sanyal, V. Balakrishnan and Captain Gopinath have done their due diligence before joining the AAP.

Everybody knew about others and the first sign that AAPtards got irritated is they will ask about other parties. Dont forget it was you who told u r unlike others so at least try to stop saying that everytime.

Yes, except them nobody is good is their argument, so prove it instead of comparing urself with them and getting satisfied. After reading about his past, even the remaining 1% of belief that he is a honest person is washed out.

The Aam Aadmi Party (AAP) government in Delhi seems to have lost it. Drunk with self-righteousness, it violated all laws and basic decency recently by rounding up and humiliating African women in the middle of the night in south Delhi.

The AAP’s defence is that its volunteers stepped in because the police was doing nothing about an alleged drug and prostitution racket.

Does that entitle them to enter women’s homes without a search warrant and, worse still, at night?

This sort of vigilantism is both disgusting and frightening. What makes matters worse is the shrill defence of the episode, with the chief minister simplistically linking rape to sex and prostitution rackets.

His remarks, besides suggesting the arrogance of a person who is riding a ‘people’s wave’, also betrays a conservative mindset.

Is violence on women merely an offshoot of crime and corruption (that mother of all problems)?

Or is it a problem of patriarchy that is within all of us — in families, in the way we think and act?

Arvind Kejriwal, the Gandhian, should have a thing or two to say about the inner being instead of going along with his Law Minister. Running the government is not about being a pugilist all the time.

But his party is drifting on a cloud of moral righteousness and Kejriwal seems to have forgotten Gandhi for the moment. All we see is a here-and-now, 24×7 zeal, the bizarre search for a clean, pure society (in which Africans can find no place?).

It’s frightening to see these lakhs of AAP volunteers burning with impatience to wipe out ‘corruption’. Corruption becomes a metaphor for dirt, an excuse to externalise the prejudices within us.

Who are these internet-savvy volunteers? If their jottings in Facebook and other websites are anything to go by, they abhor complexity of thought, an engagement with ideas, and particularly, a reference to political history.

“We want to remove corruption now, please do not burden us with your baggage”, is the refrain.

They represent the alarming anti-intellectualism of a section of the middle class, and are, in all likelihood, students or products of engineering and management institutes whose biases have remained intact in the absence of an exposure to liberal streams of thought.

One can only hope that the views of this section do not reflect the core sensibility of the AAP.

Kejriwal’s responses on the issue of the African women as well as on the political rights of Kashmiris betray some sort of connect with this section of the middle class.

Will saner elements in the party be able to alter the tenor of the discourse?

AAP’s enthusiastic volunteers want to see the world slotted into neat categories of ‘good’ and ‘bad’ so that they can actively, if not violently, be part of the solution.

Unable to cope with complexity, they rush to so-called ‘god’men, hyper-personalities such as Kejriwal or Narendra Modi, or, to extend the examples across space and time, the Osama Bin Ladens and even the Charu Mazumdars. They are ‘fundamentalists’.

Insightful views
Salman Akhtar, professor of psychiatry, Jefferson Medical College, has spoken insightfully on the “lure of fundamentalism”.

In his inaugural lecture at the Centre of Psychoanalytic Studies, Delhi University, in May 2005, he observed: “Instead of complexity, fundamentalism offers simplicity, instead of moral ambiguity, fundamentalism offers moral clarity… Instead of cultural impurity and hybridisation, fundamentalism offers purity.”

He went on to say: “Fundamentalism lulls us into a sleep of childhood, a sleep of simplicity but it is worse than childhood because a child is always questioning and attempting to come out of its innocence bit by bit.”

The extent of AAP’s ‘innocence’ is disconcerting.

The experienced elements in the party must strive towards moderation.

One way of jettisoning the muck in the flood of new members (to borrow a metaphor used by AAP leader Yogendra Yadav in a recent interview) is to take clear social and political positions.

‘Corruption’ (the slogan, not the issue) should take a backseat in the party’s lexicon in favour of a more enlightened view of social change.

The party may then shed its ‘fundamentalist’ tendencies.

External Affairs Minister Salman Khurshid said the Aam Aadmi Party was creating problems with friendly countries.

“It is completely wrong. They are not here. The high commissioner is not here… I am accustomed to seeing these kind of letters which they transpose and play around with. This is a letter dated June 2013. It is sad that they are playing with the country’s reputation. You are playing with country’s relationship with friendly countries. I cannot think of anything greater in terms of betrayal of this country than what is being done, Khurshid said.

Asked about the identity of the Ugandan official, Bharti only said: “I will not reveal the identity of the official, who is a whistle-blower. I am aware that the Ugandan High Commission is closed for holiday. Had they not been on a holiday, more details on the issue would have come out.”

The ROKSO (Register of Known Spamming Operations) is a list of the 200 top operators in the world, who are estimated to contribute about 80% of all spam. One of the criteria for being listed in the ROKSO is that at least three ISPs should have previously terminated the operator for spamming.

Three Indians figure in the ROKSO list, maintained by SpamHaus.org. We met up with one of them, Somnath Bharti.

Bharti, an MSc graduate from IIT Delhi runs an IT firm ‘Madgen solutions’ based in Delhi. The Spamhaus case against Bharti is that he is spamming on behalf of a company called Topsites LLC.

Two ISP’s-Estelcom based in Gurgaon and SRILRPG in Delhi, host Somnath Bharti in India. Of these, we contacted Estelcom, as Estelcom had more IP addresses listed in the ROKSO.

According to Somnath, he got listed in the ROKSO after Conrad Longmore, an editor at the Open Directory Project and the webmaster of dynamoo ran a story on him ( http://www.dynamoo.com/diary/topsites_topsitez…. ).
Says Bharti, "Each of the e-mail which we send does respect all the laws laid out for business communication through e-mail like

SpamHaus, meanwhile, states “The USA’s CAN-SPAM Act merely outlaws the sending of spam with false or misleading sender information (and other specified conditions). That in no way makes the sending of ‘non-forged’ spam OK. Nor does CAN-SPAM override anti-spam filter policies. CAN-SPAM specifically permits networks (including ISPs) to prohibit spam per their own policies”.

In our interactions with Estelcom (Brajesh Jain, Vice President), what emerged was that they had taken up the issue with Mr Bharti, who in turn had assured them that he was not spamming.

It did not take too much effort to figure out that Bharti had been sued in the California Superior court for spamming by Dan Balsam. We established contact with Timothy Walton, Balsam’s attorney and here is what he had to say.

“The court record contains a declaration I made under penalty of perjury on September 8, 2004: “Directories LLC, Topsites, LLC, Paperless Mail, Inc. Paul Aunger, Somnath Bharti and David Nale have agreed to use only confirmed opt-in e-mail addresses when sending commercial messages and have further agreed to pay Plaintiff Five Thousand Dollars ($5,000) in damages.” Most settlements are out of court. In this particular case, however, the judge had to approve the settlement. Upon application, the judge dismissed the defendants and they agreed to pay.”

In his defense, Bharti claims that defending the case in the USA would have been far more costlier than settling it and that that is why he chose to settle.

In our meetings, Somnath Bharti and Estelcom claimed that they were in touch with SpamHaus but SpamHaus was extremely slow in taking action.

Our experience with other ISPs trying to get their SBL listings removed was quite on the contrary. SpamHaus acts fairly fast. To cross check, we contacted Spamhaus, and they denied that either Somnath or Estelcom had contacted them.

Here is what Steve Linford, CEO of Spamhaus had to say about the matter.
“As far as I can tell we have never been contacted by either Somnath Bharti or estelcom.com.
However, there would be no point in Somnath Bharti contacting us, unless he wants to tell us that he has stopped spamming, as we do not remove any records simply because the spammer asks us to.

NEW DELHI, Jan 24, 2014, DHNS:

With six more homeless persons found dead in different parts of Delhi late on Wednesday night, the toll of destitute shivering to death has crossed the 400-mark this winter season.

Since December 1 last year, a total of 401 homeless persons have died at different locations across Delhi. This year itself, 180 such people have succumbed to the cold weather conditions.

NGOs working to provide shelter the homeless from the winter cold, said last winter, a total of 1,127 persons lost their lives to the winter cold. The data is from November 1, 2012 to March 31 last year.

This year, the most number of deaths have been reported from north Delhi and Kashmere Area in particular. Lack of sufficient shelter homes in this area has forced organisations working for the destitute.

They claimed that about 2,500 homeless persons are left to sleep in the open. Only 400 such people can be accommodated in the 10 shelter homes in the area.

The rate at which the homeless people are dying due to cold had forced the National Human Rights Commission to take notice. It had issued a notice to the Chief Secretary of the Delhi Government on six deaths that took place on the rain-hit night of January 18.
