One of my relatives wants to get a passport. Now docs adviser asks for NECR proof. Problem is he doesn’t have any proof mentioned on the site. Like he hasn’t done matriculation, nor he is 50 or above, nor he is paying ITR. I have checked all options but can’t find a way. There must be a lot of ppl like him. How can all such ppl give this proof? They can’t deprived him of their rights.

If he goes abroad with an ECR passport and gets permanent Visa or Permanent residence Card.. His passport will we upgraded to Non-ECR category.

I think there is no other way.. unless he is a gezetted officer.

@batman First of all, you confused me with NECR. It’s called ECNR, bro.

Anyway, why is your relative so concerned with getting the ECNR clearance in the first place? Is he planning to immigrate to any of the ECR countries for employment?

I am gonna stick my neck out and say it used to be called ECNR.

Call me stupid but I don’t know what difference does it make to have NECR or ECR stamp? I just thought with NECR stamp, as the name suggests, there would be less hassle if and when he takes a trip. No he is not looking for employment abroad. He just wants to have a passport bcz he doesn’t have it.

Affidavit will work if he falls under a category ( of NECR ) and doesn’t have a supporting document to prove it. Like if he’s over 50 yrs and doesn’t have DOB Certificate.. he can make affidavit in this case.

(1) It’s Emigration Check Not Required (ECNR).

(2) AFAIK, they got rid of the stamp process long ago. No such stamp was there when I renewed my passport in 2010/2011. I think it’s a separate certificate for those who still want it. All school/college graduates are automatically ECNR cleared.

(3) The ECR system is anyway applicable only if someone is visiting one of listed ECR countries (mostly middle-east countries). Google the list. AFAIK, the ECNR system was introduced to protect the innocent labor class people from exploitation in the middle east. Now it’s mostly used for preventing exploitation of house maids/helps in rich countries like USA. Interestingly, there was a report of exploitation of a house maid by an Indian diplomat in NY a few years ago. https://cdn2.desidime.com/assets/textile-editor/icon_toungueout.gif

(4) So ask your relative to get a passport without the ECNR certificate and forget about this unless your relative actually plans on visiting one of the ECR countries.

Some people say.. Non Emigration Check Required : NECR
and some say.. Emigration Check Not Required : ECNR

Thanks for the detailed info. I would still think it’s better to go for ECNR bcz you never know where you might travel in future and he will have to get that certificate.

(2) Yes, thanks for digging up that Khobragade incident. Anyway, in that case, the main issue shifted to the lack of diplomatic-immunity and mistreatment by the US authorities. But if you search for other such cases, you will find quite a few horrible cases have come to light about our desi multimillionaires exploiting domestic servants in the US. Flouting of the visa rules is a very common issue. Even the owner (owner’s son, to be precise) of the famous south-India chain Saravana Bhavan was arrested in the US for running a smuggling racket and flouting the visa rules. #MoreMaterialForSearching

If not travelling to the mentioned countries (in that link ) for employment purpose, then ECR passport is good enough, otherwise a POE (PROTECTOR OF EMIGRANTS) clearance is required.
