Need urgent help please: Received an empty packet without phone inside

Hi Dimers,
I need urgent help. I had ordered nexus 5x 16 gb from amazon for 21999 and received the packet today.
I found that the packet contains only accessories and there is no phone inside. I called up cc and told them about the issue. After a long conversation the cc representative was ready to refund the money to me right away.
I want the phone but they say that the phone is not available with the seller. and the other sellers are selling it for 26499 which is 4499 rs higher than the price I have paid.
This is ridiculous. I need help from you all to help me in this issue. Please assist me the best thing I can do in this case. Thanks.

It was worst than amb ….. probably the biggest looter in Indian ecommerce…. they looted dimers as well. They never deliver and eat up customers money.

Was the money ever refunded?
My friend had 14k or something stuck there. I was mailing them professionally, thinking they are going to refund, only to read news later than the founder is going to jail for scamming everyone.
Been long time now. I hope the founder comes back and immediately buys both Amazon and Flipkart. 
Since the time I bought the phone the price have never decreased its always above 23500 only. It could be a cheap publicity stunt. Possibly Just to attract customers. Thats what came in my mind after thinking a lot over this issue.

You should start taking pictures after getting products from online sites, specifically when seller is new.
