Please do not fill the thread up with useless chatter.. So at least we can find out what is happening.

Seems certain they are going to court instead of reversing the charges for breech of contract for non-payment. Reversing charges needs to be done manually so its a long process. But they can do that.

They will go to court and proceed with breech of contract or mistake. This is done by banks regularly because funds were transferred to the wrong account and banks can reverse charges back to source.

First they will send a written request to gain permission to remove the funds and send it back to source because it was deposited by mistake. If you dont agree they will go to court and get an order to reverse it Which the courts can grant.

So it is certain that Niki will get a court order to reverse funds or charges..

Again we come to the same thing as in the beginning.

They have to manually reverse the transaction. And remove the funds from the source..

You have the choice of paying them the funds they ask. But you missed out on all the discounts. If you did JIO recharges, you could have used a variety of 10% or even JIO’s own Rs.50 discount coupon, so you would be losing 10-15% if you agree. But it is understandable that you dont want the trouble.

We can write to niki about giving them permission to reverse the charges. In which case they have to do that to recover their funds. This is what most of us should do. In the end they will have a court order to do this anyway. And it will be a long process and they have to do this manually. Some will work and some will fail n which case again they have to do this on an individual basis instead of a single court order. Which might never get to court as they have to provide reason why they could not recover.

But know this, of the 2 choices, pay now or ask them to reverse charges, if you dont want trouble pay now. Ask them to reverse charges.. If they do or dont then that is another process..

If you dont reply it means by default you are ignoring a demand for payment and courts can process it their way. Especially if you dont have a lawyer to represent you in court.

So everyone should write to them. With what they are doing. Paying now or asking them to reverse charges. You dont want a default judgement. Again mostly the default judgement would be to cancel the transaction. Which we got against someone but it is difficult to enforce. But it is trouble as well. So even if you are not going to pay, write and tell them you did not intent to make the transaction and it was their mistake.. Etc.. etc..

DO NOT PAY. They are free to reverse. Their money is at stake coz of their fucking fault, not ours. If they care, they will reverse even if they have to do it manually.

Not paying is not an easy option. It might end up not having to pay… But if they get good lawyers the verdict might end up as anything.

The numbers I recharged are different from the niki account login number. I believe they are sending it to the numbers on niki login data base and not the number recharged. My niki numbers have not been turned on from a very long time (and I don’t plan on turning it on any time soon). I know for a fact that messages would expire after a period of time and would be marked as undelivered against them in the telecom DB. When I have not received it how can they assume that I have received their notice (in this case it’s not a notice and rather a request to pay in good will).

There will be only 1 case.. Would they add your number to their numbers contacted to pay in good faith but refused? I noticed Indian courts are not very strict about adhering to rules and regulations.. Just because they are not supposed to do it, dont mean they dont.

Unless you can tell the judge or someone stands in for those who did not get the request, this will be ignored and a default judgement against refusal would come for all. Including those who never got a request for payment.

In 5 to 10 years they might get to you.. where they have the option to track you down and file against you. Will they do it? Not likely.. But like I mentioned, I am disappointed that they can lie in court papers and the judges just ignore this and dont want to deal with individual cases.

So upto you… If you have a business and such and a lot of property etc etc etc then write to niki with something.. Other wise ignore.. If I talk to a lawyer I would get this pay them and get it over with. All our default lawyer charges start at 10,000…

There are more than valid arguments with dimers in this case.
In courts it’s the intent that matters more than the act itself. For eg. A murder which is done with an intent of self defence is exempt from charges. In our case what happens is we see a coupon online and innocently thought of trying it, and it works. There is nothing more to it than this. If we knew the website would ask us to pay later we would not use it. It appeared it’s an running offer from the website. We are innocent and do not owe a single penny to anyone.

I haven’t finished my reply but thanks for pointing that out. Unlike many others I have precedent about niki misinforming customers.. I had made a bsnl recharge for 2099 which they accepted payment and deducted from my CC and then reversed via paypal a few days later.. Then they still saying I can get 50% and i made another rs500 recharge.. But never got any cash back for any of it..

So it looks like they only want others to fix their losses but unwilling to do the same for customers.. When they file court papers I will also IA my side in this including how I was cheated. How was I supposed to know which coupons were for me because even when they said it was for me, they still did not honor it. They can reverse my recharges now, just like they did it before..

what are all these kiddies doing here anyway? dont know how to read English and think they are so smart? Some of the things I seen now makes sense.

How are users supposed to know which codes are for whom? Originally I assumed this offer was like the paypal offer.. Rs500 CB on making payment.. Remember paypal also had Rs250 100% CB for dream11.. I dont think this reasoning of theirs hold water. Also it took a while before I even realized what happened as their messages were delayed a lot. ie it only showed anything after many tries.. Some of which also failed.. I cant seem to find the chat transcripts now. Seems they cleared them out. Including the failed transactions where paypal cashback never showed up.

Thats why I created this thread so we can come up with a coherent reply to this. In any case we need to come up with something to file in court against their filing. I already have the substance for the counter affidavit. Where they failed my transactions and never followed up with their offers they were advertising. So not for me or for me.. That part has no meaning.. But need to flesh it out more..

I was sad when some dimers looting 5k-8k early on a Sunday morning and thought about installing niki.. I’m glad I didn’t cuz some way or another i would face another annoying trouble.
Last year, paytm cutoff rs 375 from my balance out of nowhere and never returned my money. Now its hard for me to trust any other app except amazon.
Anyways, I hope some expert dimers here can help you out with this. Good luck!

it is always better to not do anything when emotional.. Seems niki already sold out.. But their losses dont seem too bad. Its just a small fraction of their funds. But lets see what they will do.. Almost anything they do would just make a bad situation worse but people do a lot of self destructive things..

I only went in to do 1 recharge but ended up with 4 because of their app locking up. I am fully prepared to let them pull the recharges. But since they waited this long I am not sure the companies will allow them to do it now. They have a window of a few days to cancel a transaction. As it is a long process for them as well. Niki dont have the years it will take to get a court order for this. This will be alexa 2.0 long before then..

Amazon aint all that much better.. Many of their employees sleep in cardboard boxes so they dont have to travel 4 hours a day to their homes. They keep bottles handy so they they dont waste 5 minutes to go to the bathroom and eat premade ready to eat meals so they can finish lunch as fast as possible. I do not support amazon at all.. But at least their US version has great customer care.. indian version like the bnsl lady told me, we are a third world country, what do you expect..

Also every day amazon app provdes me less functionaly than the week before.. I am almost out of being able to play the daily quiz now.. After that it would be totally useless app.. Even sent them feed back since they never fix any of the crash bugs which happens every day.. This is what thye call updates and progress..

So only like 1000-2000 people took advantage of it. Their system was unable to cope with the load. Imagine if this was Amazon.. Something like 50000 people used them in around the same time.
