@satswid A lot of points which the petitioner has mentioned are valid, but it is not as clear cut case as presented. First of all, normally the notice period is known when you joined the current company. It is not as if it is suddenly changed the day the person decides to resign. If there is so much problem with the policy, reject the offer letter mentioning the same reason.

There are a few other points which the petitioner is ignoring.

1) If the notice period is 3 months, that also means that in case the employee is fired, he will will also be given 3 months of notice period or salary. This may not feel like much, as hire-and-fire is not yet common in India, but is some security nonetheless.

2) Service Sector woes: The employee may not be doing a critical or specialized job, but hiring a new employee. training and inducting him/her does take time. Taking the case that replacement may be internal, even then it may take some time.

3) Tit-for-tat : If the new company has a notice period of 3 months, but is still refusing to wait for 3 months to finish previous notice period, then the new manager and HR should be shown the middle finger for being what they are.

4) Protect business interest of companies: Depending upon which type of industry you are working in, the employer also gets time to inform the vendors/contractors/clients to update them that employee will no longer be part of their organization, and this person will be the new contact person. This from banking perspective.

I support regularizing the Notice Period for all companies, but simply asking it to reduced is childish.

It’s a fact that no company needs 3 whole months to replace an employee, no matter how important he/she is.
If you spend money on training the employee, why not spend some more in employee engagements so that you can attain a good name and your employees won’t leave you.
Company needs to run business. They are earning billions bcoz of us. And they still want to enslave us.
