Lowest Price Guarantee Offer: Terms and Conditions
1) This offer (“Offer”) is provided to you by Cloudtail India Private Limited (“Seller”) and is made available to you on the website and its mobile site and mobile application thereof (collectively “Website”), which is maintained and operated by Amazon Seller Services Private Limited (“Amazon”).

2) This Offer is valid from 25th June, 2018 to 24th July, 2018 (both days included) (“Offer Period”) unless revoked or extended by Amazon and/or Seller in their sole discretion, without any prior notice and without liability.

3) You agree that, by participating in or availing this Offer, you will be bound by these terms and conditions (“Terms”). These Terms are in addition to the Amazon.in Conditions of Use & Sale which you agree by using the Website and the Amazon.in Gift Card Terms and Conditions (“Gift Card Terms”) available here. To the extent the Amazon.in Conditions of Use & Sale are inconsistent with these Terms; these Terms will prevail with respect to this Offer only. To the extent the Gift Card Terms are inconsistent with these Terms; these Terms shall prevail with respect to this Offer only.

This Offer is valid and can be availed only:
(a) if you are: (i) located in India; (ii) have set India as your current country in your account settings on the Website; and (iii) have a billing address in India;
(b) on select products purchased from the Seller on Amazon Pantry available on the Website (each, a “Product”) during the Offer Period; and

5) Subject to these Terms, if a customer (“Purchaser”), after placing an order for the Product on the Website during the Offer Period, is able to establish that a product of the same brand, variant and size [of the Product ordered] is offered elsewhere at a lower price by a third party seller, the Seller will issue cashback to the Purchaser of an amount equivalent to 2 times (2x) the difference in the price claim in the form of Amazon Pay Balance. “Amazon Pay Balance” is a sum of all the balances associated with Amazon.in Gift Cards (“Gift Cards”) in your Amazon.in account. Gift Cards are issued Qwikcilver Solutions Private Limited and are subject to the Gift Card Terms.

6) The following conditions needs to be fulfilled by the Purchaser to file a cashback claim under this Offer:

(a) The product of the third party seller, which is the subject-matter of the claim, should be:

(i) identical to Product(s) purchased by the Purchaser (i.e., of the same brand, same variant and same size); and
(ii) offered and deliverable within the same city where the Product order is to be delivered to the Purchaser.

(b) Any claim under this Offer must be raised by the Purchaser within a period of 3 days from the date on which the Product order is placed on the Website. For the purposes of verifying a Purchaser claim, the Seller will consider product prices offered by the relevant third party seller during the period of 3 days from the date the Product order is placed by the Purchaser.

© The price of the product offered by the third party seller must be of a lower price for at least 24 hours after a claim (along with supporting documents as mentioned below) is submitted by the Purchaser.

(d) Contact Amazon Customer Servicefor filing claims under this Offer along with the following supporting documents/data in relation to the identical product of third party seller:

(i) Screenshot of the relevant page on mobile application, mobile browser or website with product, its price, date & city clearly visible (along with URL in case of mobile browser/website); or
(ii) Photo of newspaper advertisement with product, its price, date & city clearly visible; or
(iii) iii. Tax Invoice of the purchase made at a store in the same city from which the Product is purchased. Such tax Invoice shall be compliant under applicable laws and shall contain the name, address and contact details of the registered entity of the third party seller.

A Purchaser claim will not be entertained if he/she is not able to furnish any one of the above document/data.

(e) In addition to the aforesaid documents, the Purchaser will also be required to share the Product order ID while filing a claim with Amazon Customer Service.

7) On receipt of claim (along with necessary documents/data) from the Purchaser under this Offer, it will take 3 working days to verify and validate the claim.

8) In case the Purchaser’s claim under this Offer is found to be factually correct, the applicable cashback amount under this Offer will be credited to the eligible Purchaser’s Amazon.in account in the form of Amazon Pay Balance, –

(a) if the Product order has been delivered to the Purchaser, within 72 business hours of claim validation; or
(b) within 72 business hours of the Product delivery.

9) The maximum benefit/cashback that can be availed by a Purchaser under this Offer is, –

(a) Per order – Rs. 200/- per order placed for the Products, and
(b) Rs. 2000/- during the Offer Period.

10) The Offer will not be available on purchase of any other product listed on the Website other than the Products.

11) This Offer is being made purely on a “best effort” basis and availing the Offer is voluntary.

12) In the event of cancellation of your order for the Product (either by you or Seller) or the purchased Product is returned or exchanged by you, you will not be eligible to file a claim or receive any cashback under this Offer.

13) There are no cash or other alternatives available in whole or in part, in relation to the benefit under this Offer. No requests for transfer or assignment of the benefit under the Offer shall be entertained.

14) All applicable taxes and levies in relation to the Product and the Offer, including without limitation sales tax, service tax, goods and services tax etc., shall be payable by you.

15) This Offer is governed by the laws of India. Any disputes arising out of and in connection with this Offer shall be subject to the exclusive jurisdiction of the courts of New Delhi only.

16) You agree that all decisions of Amazon and/or the Seller (as the case maybe) related to the Offer, including the validity of Purchaser claim, are final and binding on you. Failure by Amazon or the Seller to enforce any of these Terms, in any instance, shall not be deemed to be a waiver of the Terms and shall not give rise to any claim by any person.

17) Amazon and/or the Seller reserves the right to add, alter, modify, change or vary all of these Terms or to replace, wholly or in part, this Offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether, at any time without prior notice and without assigning any reason whatsoever.
