The Offer is applicable only to selected products from the Watches and Luggage & Travel Accessory categories sold by the Sellers on the Platform (“Applicable Product/s”) during the Offer Period. You are required to check the product page for Offer applicability before placing an order.
Under this Offer, Cardholders can avail an instant discount of 10% on the price of an Applicable Product when purchased using a Card (can be availed only once per Card, add on Cards will be treated separately) subject to a maximum of Rs. 2 000.00 (“Offer”).
There is no requirement of a minimum transaction value to avail this Offer as long as the above requirements are being fulfilled.

TERMS AND CONDITIONS

PRELIMINARY

1. This Offer (defined below) is being run by Consulting Rooms Private Limited (Omnitech Retail), Tech Connect Retail Private Limited (Retail Net) and WS Retail Services Private Limited (WS Retail) (“Sellers”) on www.flipka...om, Flipkart Mobile App, Flipkart Lite Platform (all three collectively “Platform”), which Platform is owned and operated by Flipkart Internet Private Limited. It is open to all residents of India holding a valid and current Visa, Mastercard, American Express, Maestro, Diners, Rupay Credit/ Debit card (“Cardholder” and “Card”).
2. By participating in this Offer (defined below), Cardholder agrees to be bound by:
a. these terms and conditions (“T&C”);
b. the Terms of Use, Privacy Policy and other relevant documentation including any modifications, alterations or updates thereof, that are published on the Website; and
c. the terms and conditions of the issuing bank of Your Card and applicable card association rules.

OTHER TERMS AND CONDITIONS

7. Offer not applicable to Net Banking, Card on delivery transactions and EMI based transactions.
8. Discount is not applicable on gift wrap or premium delivery charges.
9. In case of partial payment made using Flipkart Gift Card/ Wallet, discount will be valid only on the amount paid through the Card.
10. In case of cancellations, Cardholder will not be eligible for this Offer. If Cardholder cancels part of the order, they will qualify for the Offer only on the net amount paid, basis eligibility.
11. Delinquent and over-limit credit Cardholders will not qualify for this Offer. Flipkart does not endorse the Applicable Products and will not accept any liability pertaining to the quality, merchantability, fitness, delivery or after sales service of the Applicable Products, which shall be at the sole liability and responsibility of the Sellers.
12. Pictures of products shown in the communication sent either through mailers or displayed on the Platform, are representative only and may not bear a resemblance to the Applicable Products. None of the parties shall under any circumstances be responsible towards the same.
13. Sale of Applicable Products on the Platform is subject to availability with the Sellers and accordingly Flipkart shall in no circumstances be liable for non-availability of any of the said products.
14. Under no circumstance will the discount being offered under this Offer be settled with cash in lieu by Flipkart or the Sellers.
15. Flipkart reserves the right to disqualify respective Cardholder(s) from the benefits of the Offer, if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the said Offer or otherwise by use of the Card.
16. Flipkart will not entertain any correspondence regarding the validity or acceptability of any additional benefits offered by the Sellers and the same shall be at the sole risk and consequences of the Sellers and without reference to Flipkart.
17. All government Levies etc. shall be payable by the Cardholder as applicable at the time the respective Offers were offered.
18. This Offer shall be subject to all applicable laws, rules and regulations which are in existence and which may be promulgated anytime by any statutory authority.
19. This Offer shall be governed in accordance with the applicable laws in India. Courts in Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this Offer.
20. Cardholders are not bound in any way to participate in the Offer. Any such participation is voluntary and the same is being made purely on a best effort basis.
21. Any query regarding the Offer will be entertained only till March 31st, 2017. Post such date, Flipkart will not entertain any correspondence or communication regarding this offer from any persons.
22. Flipkart reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this Offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether. These T&C shall be in addition to and not in derogation of the terms contained in the card member agreement.
23. Flipkart or the Sellers shall not be liable for any failure by bank to honor the transaction and for any technical issues as a result of which the transaction made by the Cardholder was not successful.
24. The Cardholder shall indemnify and hold Flipkart and Sellers harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney’s fee) that may be suffered by the Sellers as a consequence of (i) violation of these T&C, of the terms of user agreement, privacy policy (subject to change) as mentioned on the Platform; (ii) violation of applicable laws; and (iii) any action or inaction resulting in willful misconduct or negligence by or on the part of the Cardholder.
25. This Offer is valid only in India. The minimum age of such Cardholder shall be 18 years.
26. Further, as required by applicable law, in the event that the Cardholder makes a purchase of an amount equal to or above INR 2 00 000.00, the Cardholder will be required to upload a scanned copy of his/her PAN card on the Platform, within 4 days of making the purchase, failing which, the purchase made by the Cardholder will be cancelled. The requirement to submit the PAN card arises only once and if it has been submitted once by the Cardholder, it need not be submitted again. The order of the Cardholder will be cancelled if there is a discrepancy between the name of the Cardholder and the name on the PAN Card.
27. This document is an electronic record in terms of Information Technology Act, 2000, and the Rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
