TERMS AND CONDITIONS

PRELIMINARY

1. This Offer (defined in “Offer Details” section) is being run by OmniTechRetail (“Seller”) on www.flipka...om, Flipkart Mobile App, Flipkart Lite Platform (all three collectively, “Platform”), which Platform is owned and operated by Flipkart Internet Private Limited (“Flipkart” , “We” or “Our”).
2. By participating in this Offer, user (“You”, “Your” or “Customer”) agrees to be bound by:
a. these terms and conditions (“T&C”); and
b. the Terms of Use, Privacy Policy and other relevant documentation including any modifications, alterations or updates thereof, that are published on the Platform; and
c. Terms and conditions of the Seller.

3. Offer is valid from 29th September 2019 (00:00 hrs) to 4th October 2019 (23:59 hrs) (“Offer Period”). For Flipkart Plus members, sale will begin from 20:00 Hours, Sep 28th 2019 to 23:59 Hours, 4th Oct, 2019.
4. On purchase of Selected products sold by the OmniTechRetail (Seller) on the Platform during the Offer Period, You will get an extra ₹750 off on all prepaid transactions using Your valid and current credit card /debit card of any bank listed in Annexure 1 or Netbanking (“Offer”).

5. To avail this Offer, You must do/ fulfil the following:
a. Age must be 18 years or above;
b. Must have a valid account on the Platform and log into the same;
c. Purchase selected eligible products sold by the Seller on the Platform (“Product(s)”) during the Offer Period using Your valid and current credit card /debit card of any bank listed in Annexure 1 hereto or Netbanking (“Eligible Payment Method”).
6. Upon fulfilling the above requirements, You will get an instant discount of ₹750 on Net Cart Value (NCV) of eligible product
7. Discount on the Product will be applied at the time of checkout.
8. The Offer will not apply on payments made via the PhonePe payment container.

OTHER TERMS AND CONDITIONS

1. Offer not applicable to Card on delivery transactions, payments made through gift cards or any other transactions save for the Eligible Payment Method.
2. A maximum of 1 transactions per Customer can be made under this Offer.
3. Offer is applicable for EMI as well as non-EMI transactions made using valid debit or credit cards of any bank listed in Annexure 1hereto.
4. Flipkart does not endorse the Products and will not accept any liability pertaining to the quality, merchantability, fitness, delivery or after sales service of the Products, which shall be at the sole liability and responsibility of the brand or the Sellers.
5. Pictures of Products shown in the communication sent either through mailers or displayed on the Platform, are representative only and may not bear a resemblance to the Products. None of the parties shall under any circumstances be responsible towards the same.
6. Sale of Products on the Platform is subject to availability with the Sellers, and accordingly Flipkart under no circumstances shall be liable for non-availability of any of the Products.
7. Flipkart shall not be liable for any failure by the Seller to honor the Offer terms. The Seller shall indemnify and hold Flipkart harmless against any claims by Customers in this regard.
8. Returned transactions, disputed or unauthorized/fraudulent transactions will not be considered for the Offer

9. Under no circumstances will the discount being offered under this Offer be settled with cash in lieu by Flipkart or the Seller.
10. Flipkart reserves the right to disqualify You from the benefits of the Offer, if any fraudulent activity is identified as being carried out for availing the benefits under the said Offer or otherwise.
11. Flipkart will not entertain any correspondence regarding the validity or acceptability of any additional benefits offered by the Seller and the same shall be at the sole risk and consequences of the Seller and without reference to Flipkart.
12. All government levies etc. shall be payable by You as applicable at the time the Offer was offered.
13. This Offer shall be subject to all applicable laws, rules and regulations which are in existence and which may be promulgated anytime by any statutory authority.
14. This Offer shall be governed in accordance with the applicable laws in India. Courts in Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this Offer.
15. You are not bound in any way to participate in the Offer. Any such participation is voluntary and the same is being made purely on a best effort basis.
16. Any query regarding the Offer will be entertained only till 10 days from the day of delivery of the Product. Post such date Flipkart or the Seller will not entertain any correspondence or communication regarding this Offer from any persons.
17. Flipkart or Seller reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary these T&C or to replace, wholly or in part, this Offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether.
18. Flipkart or the Seller shall not be liable for any failure by bank/ UPI facilitator to honor/ facilitate Your transaction or for any technical issues because of which the transaction made by You is unsuccessful.
19. Any disputes arising out of the Offer shall be subject to arbitration by a sole arbitrator to be appointed by the Seller for this purpose. The proceedings of the arbitration shall be conducted as per the provisions of Arbitration and Conciliation Act, 1996. The place of arbitration shall be at Bangalore for the Seller and language of arbitration shall be English. The existence of a dispute, if any, shall not constitute a claim against the Seller.
20. Flipkart shall not be liable with respect to the Products purchased.
21. You shall indemnify and hold Flipkart and the Seller harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney’s fee) that may be suffered by Flipkart or the Seller as a consequence of:
(i) Your violation of these T&C, or of the terms of use agreement, privacy policy (subject to change) as mentioned on the Platform;
(ii) Your violation of applicable laws; and
(iii) any action or inaction resulting in wilful misconduct or negligence on Your part.
22. This Offer is valid only in India. The minimum age of such Cardholder shall be 18 years.
23. Further, as required by applicable law, if You make a purchase of an amount equal to or above Rs. 2,00,000, the Cardholder will be required to upload a scanned copy of his/her PAN card on the Platform, within 4 days of making the purchase, failing which, the purchase made by the Cardholder will be cancelled. The requirement to submit the PAN card arises only once and if it has been submitted once by the Cardholder, it need not be submitted again. The order of the Cardholder will be cancelled if there is a discrepancy between the name of the Cardholder and the name on the PAN Card.

24. This document is an electronic record in terms of Information Technology Act, 2000, and the Rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
