In the event of item(s) rejected or returned by the Purchaser, or/and item(s) refunded to the Purchaser, the order will remain eligible as per the order value at the time of placing order, but the cashback would be calculated proportionally as per the final order value. However, in the event such order is fully cancelled by either the Purchaser or the seller, the Purchaser will not be eligible to receive any cashback.

FLAT 15% CASHBACK OFFER TERMS AND CONDITIONS
This Flat 15% cashback offer (“Offer”) is provided and funded by Cloudtail India Private Limited (hereinafter referred to as “Seller”) and made available on the Prime Now mobile application (hereinafter referred to as, “Prime Now App”) by Amazon Seller Services Private Limited (“Amazon”).

These offer terms and conditions (“Offer Terms”) are in addition to the Prime Now Service Terms and Conditions, the Amazon.in Conditions of Use & Sale and Privacy Notice as available on the Prime Now App to which you agree by using the Prime Now App. To the extent the Prime Now Service Terms and Conditions, the Amazon.in Conditions of Use & Sale, and Privacy Notice are inconsistent with these Offer Terms, these Offer Terms will prevail with respect to the Offer only.

You may only avail this Offer if you are: (a) located in India; (b) have set India as your current country in your account settings on Amazon.in; and © have a serviceable billing address in India.

This Offer will commence on December 26, 2018 and end on December 28, 2018, both days inclusive (“Offer Period”), unless revoked or extended by Seller in its sole discretion without any prior notice.

During the Offer Period, each customer purchasing any Eligible Product(s) listed on the ‘Now Store’ on Prime Now App by Seller and having valid and subsisting Amazon Prime membership (each such order hereinafter referred to as “Eligible Order” and each such customer as a “Eligible Prime Customer”) will be eligible to receive promotional Amazon Pay balance amounting to 15% of the Eligible Order value, subject to a maximum of INR 600/- (“Benefit”), provided that the net order value of the Eligible Order (exclusive of shipping charges) is equal to or more than INR 1500/-.

The Benefit will be provided in the form of promotional Amazon Pay balance in the Amazon.in account of the respective Eligible Prime Customer. The Benefit under this Offer is funded by the Seller to the absolute exclusion of Amazon and will be provided to the Eligible Prime Customer within 15 (fifteen) working days of the delivery of the Eligible Order.

In the event when an Eligible Order is partially fulfilled (i.e., item(s) cancelled or substituted by Seller) the order will remain eligible, and the Benefit calculated as per the order value at the time of placing order. In the event item(s) are rejected or returned by the Eligible Prime Customer, or/and item(s) refunded to the Eligible Prime Customer, the order will remain eligible as per the order value at the time of placing order, but the Benefit would be calculated proportionally as per the final order value. However, in the event such order is fully cancelled by either the Eligible Prime Customer or the Seller, the Eligible Prime Customer will not be eligible to receive any Benefit.

There are no cash or other alternatives available in whole or in part, in relation to the Benefit under this Offer. No requests for transfer or assignment of the Benefit under the Offer shall be entertained.

This Offer is applicable only on grocery, health & personal care, baby, household supplies, pet care, beauty products, kitchen essentials, home decor & furnishing and home appliances (“Eligible Products”). In the event you fail to comply with any term under these Offer Terms, you will not be eligible to receive any Benefit under this Offer.

All disputes between you and the Seller in relation to the Offer or any claim related thereto will be resolved inter se and Amazon will not (nor will be liable or obliged to) mediate or resolve any dispute or disagreement between you and the Seller.

The Seller reserve the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change any or all of these Offer Terms, or to replace, wholly or in part, this Offer by another offer, whether similar to this Offer or not. The Seller, further, reserves the right to disqualify any customer from the Benefit under the Offer if any fraudulent activity is identified as being carried out for the purpose of availing the Offer.

Amazon has a right to remove the Offer from the Prime Now App at any time, in its sole discretion, without any prior notice or liability.

You agree that all decisions of the Seller related to the Offer are final and binding on you. Failure by the Seller to enforce any of these Offer Terms, in any instance, shall not be deemed to be a waiver of the Offer Terms and shall not give rise to any claim by any person.

This Offer is being made purely on a “best-effort” basis and participating in or availing the Offer is voluntary. By participating in this Offer, every customer expressly agrees that Amazon or any of its affiliates will not be liable or responsible for any loss or damage whatsoever that a Eligible Prime Customer may suffer, directly or indirectly, in connection with this Offer, including but not limited to that associated with his/ her use or misuse, and/or any other matter in relation to products purchased under the Order.

This Offer is governed by the laws of India. Any disputes arising out of and in connection with this Offer shall be subject to the exclusive jurisdiction of the courts of New Delhi only.
