TERMS & CONDITIONS DROOM DIWALI MELA OFFER

This offer/ deal (hereinafter referred as “Offer”) is being organized by Droom Technology Private Limited (Referred as “Droom”) and is open to all applicants for participation (Referred as “Participant(s)” ”You”, “Buyer”), winners of the prizes mentioned under these Terms and Conditions are referred to as (“Winners”) and prizes under these Terms and Conditions will be referred as (“Prize”/ “Prize money”), You/Participants under this Offer have to comply with the below mentioned criteria’s to be eligible for this Offer:
1. They are citizens of India;
2. They are above 18 (Eighteen) years of age;
3. The Participants are registered users of the www.dr...in website and/ or Droom mobile app.
Droom Employees & immediate relatives of the employees of Droom shall not be eligible to participate in this Offer.
By participating in the Offer, the Participants agree to be bound by any rules, regulations, guidelines or policies (“Terms & Conditions”) associated with this Offer, including without limitation these terms and conditions, and agree to be bound by any decisions made by Droom, including any interpretations of such rules by Droom. The Participants hereby agree and undertake that mere announcement/declaration of being announced as winners shall not entitle them to the prizes. Only upon complying with all the Terms & Conditions mentioned herein, to the satisfaction of Droom shall the winning be validated.

Terms & Conditions:

This Offer shall commence on 6th of September 2019 from 2 PM onwards till 8th November 2 PM (“Promotion Period”) and the Offer shall only be valid if the order is placed by Participant/ You during this time period.
This Offer can not be combined with any other offers.
This Offer is only valid on one (01) single order placed by the Participant on Droom.in website or mobile app
This Offer is NOT APPLICABLE for the walk-in customers who are visiting directly at the dealership location. The offer stands valid only on transactions done on Droom.in website and mobile application.
One daily lucky winner of a 2-wheeler will be announced after the Promotion Period, from the pool of users who have bought the 2-wheeler during the Promotion Period on Droom and the transaction is closed as per Droom’s policies. The lucky winner will get the 2-wheeler at INR 999. The amount paid by the winner after deducting INR 999 will be refunded back to the buyer which would be maximum upto INR 25,000.
One weekly lucky winner of a 4-wheeler will be announced after the Promotion Period, from the pool of users who have bought the 4-wheeler during the Promotion Period on Droom and the transaction is closed as per Droom’s policies. The lucky winner will get the 4-wheeler at INR 9999. The amount paid by the winner after deducting INR 999 will be refunded back to the buyer maximum refund will only be upto INR 2,50,000.
One monthly lucky winner of a luxury 4-wheeler will be announced after the promotion period, from the pool of users who have bought the 4-wheeler or 2-wheeler during the promotion period on Droom and the transaction is closed as per Droom’s policies. The lucky winner will get the luxury 4-wheeler at INR 99,999. The amount paid by the winner after deducting INR 99,999 will be refunded back to the buyer maximum refund will only be max upto INR 10,00,000.
Date of order will be considered for choosing the daily, weekly and monthly winners. The time period for the Prize money to be refunded back in the winners account may vary as per different bank policies and further, Droom disclaims all liability in case there is any transaction error at any bank’s end. In case of any dispute regarding the transaction of the Prize money, the winner will contact the bank directly and Droom will not be held responsible in any manner whatsoever.
Income tax, gift tax or any other statutory taxes, duties or levies may be applicable from time to time, arising out of the Prizes. It is clarified that these charges are not included in the Prizes and shall be payable by the winners of the Prizes. Droom may at its sole discretion deduct all applicable taxes at source before refunding the Prize money back to the winners.
Droom may ask for additional information before processing your Prize.
Droom reserves the right to cancel your order and refund you the amount without explaining any reason (s). Droom may, in its sole discretion, disqualify any Participant found to be: (a) tampering with the entry process or the operation of the Offer or www.droom.in website or mobile application; (b) acting in violation of these Terms & Conditions; or © acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person.
Droom further reserves the right to change/ modify these Terms and Conditions and/ or criteria of the Offer and / or the Prizes for the offer/ deal and/ or the duration/ timing of the offer/ deal, at any time at their own discretion and without any prior notice and without assigning any reason.
This Offer can end anytime without prior notice at Droom’s sole discretion.
Droom is not responsible for: (a) lost, misdirected, late, incomplete, or unintelligible entries or for inaccurate entry information, or by any technical or human error that may occur in the processing of entries; (b) any printing or typographical errors in any materials associated with this Offer; © any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website; or (d) injury or damage to any computer or mobile resulting from downloading any materials in connection with the offer/ deal; or (e) for any reasons beyond the control of Droom.
The winners will be asked to provide over email their personal information, PAN number, bank account details, address proof, etc. and such other details as may be required by Droom to process the Prize in a timely and smooth manner. Droom reserves the sole right to cancel the Prize at any time in case the winner does not provide valid and necessary details required by Droom.
It is the Participant’s responsibility to ensure that their personal details (name, address, date of birth, email id, ID Proof) are always updated and accurate in order to be able to receive the gratification/ notification in time. Droom will not be liable for any loss/damage incurred by the winner in lieu of wrong/misleading information provided by the Participant.
The personal information of the winners shall be used by Droom, its affiliates, associates, authorities, agents and service providers for the purposes of this Offer (as applicable).
Full transaction is considered closed once buyer and seller meets and complete their obligations and the vehicle is delivered to the buyer.
Please refer to the item checklist before you meet the seller for the successful transaction closure.
This offer can only be availed with the payment method(s) and options mentioned in listing details or deal page. The payment method(s) can be updated by Droom in it’s sole discretion anytime Droom deems fit.
Buyer is responsible for reaching out seller and coordinate the transaction closure process.
Buyer and sellers are responsible for following all the rules and regulations prescribed by RTO for buying, selling, transfer and registration of the vehicle brought by the Buyer on Droom.in website or mobile app.
Buyer will solely be responsible for procuring insurance and other documentation(s) that is required by law at his/her own cost. Droom will not be responsible in any manner to provide insurance and any other required document which is required under law.
This Offer is subject to force majeure circumstances including without limitation, floods, natural disasters, war, act of terror, political unrests, technical snags, act of God or any circumstance beyond the reasonable control of Droom (“Force Majeure Event”). Droom shall be not liable for any delay or adverse effect caused to the participants in the offer/ deal including the winners because of a Force Majeure Event.
By participating in the Offer and accepting the prizes, the winners waive all copyrights and any related rights and consents to Droom’s right to click photographs, take pictures, shoot audio-visuals, tape, record, exhibit or portray them as the winners or publish any content submitted by them. The winners further grant irrevocable consent in perpetuity to use, edit, exhibit, publish and/or exploit the same, in any and all applications including advertising, commercials, promotion, stories, text, illustrations, articles and commercial exploitation, throughout the world, in any and all media, mode or format whether now existing or hereinafter developed, including but not limited to radio, broadcast and television, newspapers, magazines, and electronic media, at any time without the winners further knowledge or consent and without any compensation whatsoever.
Participants acknowledge that they will not hold Droom liable for any loss of opportunity, monetary loss due to their participation in this Offer.
Participation in this Offer is voluntary and Participants hereby agree to release Droom and its subsidiaries, employees, directors, shareholders, from any liability for any indirect, special, incidental or consequential damages of any kind.
There may be additional costs involved for transfer, registration and other services which the buyer will solely incur at his/her own cost.
Previous buyers of products under promotional offers from Droom will be subject to verification by Droom and upon verification, can barred from purchasing any products on Diwali Auto Mela . Any decision regarding this will be final and binding on the previous buyer(s).
If the deal is rejected, Verification department of Droom will inform the Participant with valid reason(s) in writing.

The invalidity or unenforceability for any reason of any part of these Terms & Conditions shall not prejudice or affect the validity or enforceability of the remaining parts and each part of these Terms & Conditions is distinct and at all times severable from the rest of the Terms & Conditions.
Abovementioned Terms & Conditions shall be construed in accordance with the applicable laws of India. Any or all disputes arising out of this Competition shall be subject to the exclusive jurisdiction of the courts of New Delhi only.
