This limited period promotional offer (“Offer”) is made available to you on the website https://www.koov...m/ and its corresponding mobile site (collectively, “Website”) by Marble E-Retail Private Limited (“Koovs”), along with Amazon Pay (India) Private Limited (“Amazon”).

These terms and conditions (“Offer Terms”) are applicable to you to avail the Offer. These Offer Terms are in addition to the terms and conditions applicable to your usage of the Website. In the event of any conflict between any terms and conditions of use of the Website and these Offer Terms, these Offer Terms will prevail, for the purposes of this Offer.

The Offer is valid from May 9, 2018 to May 31, 2018 (both days inclusive) (“Offer Period”), unless revoked or extended by Koovs or Amazon, in their sole discretion, without assigning any reason or prior notice, and without liability.

During the Offer Period, any customer who:
(a) purchases any product(s) on the Website; and
(b) pays for such purchase transaction using the “Amazon Pay” payment option available on the Website
will be eligible to receive the Benefits, i.e. the Discount and Cashback (defined below) under this Offer. Any customer who has completed both steps listed above, is referred to as “Eligible Customer” and the transaction made by the Eligible Customer to avail this Offer is referred to as “Qualifying Transaction”.

On completing a Qualifying Transaction successfully on the Website, an Eligible Customer will be eligible to receive the following Benefits based on the net amount of the Qualifying Transaction (inclusive of taxes):
(a) an instant discount amounting to 25% (“Discount”); and
(b) cashback amounting to 25%, subject to a maximum of INR 300 (“Cashback”).
Discount and Cashback are collectively referred to as “Benefits”.

The applicable amount of the Discount will be provided / applied at the time of check-out of the Qualifying Transaction, on the Website.

The applicable amount of the Cashback will be provided to the Eligible Customer in the form of Amazon gift card(s) (issued by QwikCIlver Solutions Private Limited) which will be sent to the e-mail ID of the Eligible Customer registered with Amazon.in. The gift cards are redeemable as Amazon Pay balance and are subject to the terms available at: https://www.amazon.in/gp/help/customer/display..... The gift card(s) will be sent within 3 days of completion of the Qualifying Transaction.

It is clarified that this Offer is only available on the Website and not on any mobile application, including the Koovs mobile application.

This Offer can be availed only once during the Offer Period by an Eligible Customer. For the avoidance of doubt, the Benefits under this Offer will only be provided for the first Qualifying Transaction and not for any subsequent transactions.

For a transaction to qualify as a Qualifying Transaction, the entire payment must be made through “Amazon Pay” payment option. Any transaction with multiple payment modes will not be considered valid under the Offer.

In the event the product(s) purchased under the Qualifying Transaction is/are returned by the Eligible Customer or the order is cancelled by the Eligible Customer, seller or Koovs, for any reason whatsoever, the Qualifying Transaction will not be considered for this Offer.

You are eligible for an exchange on the product(s) purchased on the Website in accordance with the return policy applicable to the product(s). In case the exchanged value is higher than the value of the product(s) which is/are being exchanged, the Eligible Customer will have to pay the difference between the price of the product(s) purchased and the amount paid towards the old product(s). Return of the product(s) will be accepted in case of damage on receipt or difference in product design from that on the Website.

If an Eligible Customer wishes to take a refund, a 10% deduction on the value of the product(s) paid by the Eligible Customer will be applicable on amount of the refund due to the said Eligible Customer. This deduction is a condition for availing the Benefits under this Offer. It is clarified no amount of the deduction is being received by or attributable to Amazon.

Amazon and/or Koovs reserve the right to add/alter/modify/change or vary all of these Offer Terms at any time, without prior notice, without liability, and without assigning any reason whatsoever, or to replace (wholly or in part) this Offer by another offer, whether similar to this Offer or not.

Nothing contained herein amounts to a commitment by Amazon and/or Koovs to conduct further, similar or other offers.

Under no circumstances, will the Benefits under this Offer be settled in cash in lieu thereof by Amazon and/or Koovs.

You understand and agree that Koovs is completely and solely responsible for the Discount and Amazon for the Cashback. Under no circumstances, Koovs can be held liable for the Cashback and Amazon for the Discount.

For the avoidance of doubt, any queries or complaints is relation to the Website, availability of this Offer and the Discount, need to be addressed to Koovs.

Amazon and/or Koovs reserve the right to disqualify any customer from the Benefits of the Offer, at its sole discretion, if it identifies any fraudulent activity being carried out for the purpose of availing the Benefits under the Offer or for any reason whatsoever.

By participating in this Offer, you expressly agree that Amazon or any of its affiliates will not be liable or responsible for any loss or damage whatsoever that you may suffer, directly or indirectly, in connection with this Offer, including those associated with the Discount provided by Koovs under this Offer. Amazon will only be responsible for any queries/issue(s) connected with the Cashback being provided by Amazon under this Offer.

This Offer is governed by the laws of India and any disputes arising out of or in connection with this Offer will be subject to the exclusive jurisdiction of the courts at Bangalore.

Customers are not bound in any manner to participate in the Offer. Any such participation is voluntary.

Any person availing this Offer shall be deemed to have accepted these Offer Terms.
