I. Definitions

“Alliance Partner” shall mean “One97 Communications Limited (hereby referred to as “Paytm” or “Alliance Partner”, who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
“ICICI Bank Net Banking User” shall mean a person who holds an ICICI Bank savings account, loan / facility account(s), depository account(s) and/or any other type of account(s), so maintained with ICICI Bank or its Affiliate which are eligible account(s) for purposes of ICICI Bank Net Banking Service(s) and who has received communication from ICICI Bank with respect to the Offer.
“ICICI Bank Net Banking Service(s) “shall mean internet banking services of ICICI Bank offered to ICICI Bank Net Banking User.
The offer will be applicable on the use of ICICI Bank Net banking services on ICICI Bank payment gateway, whether provided by ICICI Bank, or any other service providers appointed by ICICI Bank . Alliance partner can use other gateway for the above said promotion if the ICICI gateway is down or if the gateway is having functional issues on mutual consent. Also Alliance partner to ensure that the site is not down or shut down during the promotion period as defined above.
“Offer” shall mean such Cashback (s) /benefit(s) provided by the Alliance Partner on purchase of any products on the app or on the website using ICICI Bank net banking services during the Offer Period on the App/ Website.
“Offer Period” shall mean the period commencing from July 1, 2019 to July 31, 2019, both days inclusive.
“Primary Terms and Conditions” shall mean the terms and conditions applicable to ICICI Bank’s Internet banking facility/ service.
“Products/Services” shall mean the goods/benefits/facilities offered by the Alliance Partner.
“Website” shall mean the following website of the Alliance Partner i.e. https://paytm.com...ie or their mobile app
“Void Transaction” shall mean any transaction wherein the transaction has taken place but has been cancelled /rejected /unsuccessful by Alliance partner
All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms (“Terms”) shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail

II. Offer

Customer will be eligible for Additional 10% Cashback from ICICI Bank if eligible product is purchased using ICICI Net Banking.
Offer is valid on selected products in Fashion Category.
Minimum order amount should be equal to or more than Rs.1000 to qualify for Additional cashback of 10%. Minimum spend on ICICI Bank Net Banking should be greater than or equal to Rs. 1000 to qualify for additional cashback of 10%.
Maximum Additional Cashback per bank account that can be availed during the entire campaign period will be Rs 1000
Additional cashback of 10% from ICICI Bank (upto max.1000) will be calculated on the amount paid by ICICI Bank Net Banking.
Paytm Cashback amount mentioned on Product Display Page will be credited to customer’s Paytm Wallet within 24 hours of shipment. All the applicable TnCs of Promo Code on Product Display Page are applicable.
Additional 10% Cashback from Bank( Maximum of Rs. 1000/ bank account) will be credited in customer’s Paytm Wallet for KYC customers on or before 31st October 2019. If customer has not completed KYC or breached wallet limit, will receive Goldback (inclusive of 3% GST).
Customers making payment through any other bank net banking will not be eligible for additional 10% cashback.
Cancelled and Returned orders will not be eligible for Offer / Cashback.
The campaign will run from 1st July, 2019 to 31st July, 2019. However, ICICI Bank and Paytm reserve the right to extend or cut short the offer at their discretion.
In case of any query regarding additional cashback from bank, kindly reach out to PaytmMall or ICICI Bank by 30th Nov, 2019. No query regarding the additional cashback from bank will be entertained post 30th Nov, 2019.
III. Terms & Conditions prescribed by Paytm

The Offer is only valid on bookings made using ICICI netbanking payment mode.
This Offer is NOT applicable on non-ICICI account holders.
The Offer is valid only on the first eligible transaction per user per month during the Offer Period.
In the event of ICICI netbanking being used to make a subsequent booking, it will be eligible for regular offer but not for the same offer.
The offer is not valid on payments made through Paytm Wallet, or Paytm Bank Account.
Transactions completed during this Offer Period with the appropriate promo code will only be considered.
For all bookings, the cashback amount shall be credited to the user’s Paytm Wallet within 24 hours a successful purchase
Cashback will be calculated on each Order ID and not on the number of transactions.
If the Customer does not receive the cashback amount, he/she can claim for the same within 1 month from the booking date. In the event the Customer fails to do so, he/she will not be eligible for the cashback amount.
Products and services are subject to availability.
For any netbanking related claims/ issues, the customer shall approach ICICI. Paytm shall not entertain any such claims.
The Customer cannot club any other offers along with this Offer on the same Order ID. The offer cannot be transferred/ assigned to any other person or Customer.
The customer shall not be entitled to cashback in the event of cancellation of booking.
User agreement and privacy policy at Paytm website shall apply.
Paytm will be entitled to reject any claim in case there is any abuse/misuse of the offer by the customer or the claim is not eligible under the offer.
ICICI and Paytm reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this offer or not, or to extend or withdraw it altogether.
In no event, the entire liability of Paytm to a Customer, entitled under the said offer, for any dispute arising in connection with this offer, shall exceed the cashback amount.
The laws of India shall govern the T&Cs of this offer. Disputes, if any, shall be subject to the exclusive jurisdiction of the competent courts/tribunals in New Delhi only.
ICICI and Paytm shall in no way be liable if any customer is unable to login to Paytm due to incompatibility of device, internet usage plans, or any other reason whatsoever.
The offer is valid only if the customer’s card account continues to be in good standing and payment continues to reach ICICI before the payment due date.
ICICI and Paytm, its group entities, or affiliates, their respective directors, officers, employees, agents, vendors, shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal injury that may be suffered or incurred, by the Customers, directly or indirectly, as a result of participating in the Offer or by the use or non-use, acceptance or decline or suitability or effectiveness of the services pertaining to the Offer.
Nothing herein amounts to a commitment or representation by ICICI or Paytm to conduct further such Offers.
If the offer and/or anything to be done by ICICI or Paytm in respect of the offer is prevented or delayed by causes, circumstances or events beyond the control of ICICI or Paytm, including but not limited to computer viruses, tampering, unauthorized intervention, interception, fraud, technical failures, floods, fires, accidents, earthquakes, riots, explosions, wars, hostilities, acts of government or other causes of like or similar or other character beyond the control of ICICI or the other entity/ies, then ICICI and/or Paytm shall not be liable for the same to the extent so prevented or delayed, and will not be liable for any consequences.
All of Paytm’s and ICICI’s actions shall be on a best-efforts basis only.
The customers agree to be bound by the terms & conditions contained herein. Without a customer being required to do any further act, he/she shall be deemed to have read, understood and unconditionally accepted the terms & conditions herein.
