The Refer a friend Offer (the “referral offer”) is being offered by Reliance Communications Ltd. (RCOM) and is available only for existing and prospective [who have done the registration during the referral offer period] prepaid customers (the “eligible subscribers”) of Reliance Global Call service (the “Service”) who reside in India.
The referral offer will not be applicable for Pay After Use customers of the service.
Program Description: Subject to these Terms & Conditions, RCOM will reward the eligible subscribers in accordance with the referral offer benefits (as specified below) for each customer referred by an eligible subscriber and who does the registration for the Service during the referral offer period (a “Successful Referral”). The eligible subscriber can refer up to 10 persons.
Persons Who May Be Referred: Any eligible subscriber may refer only persons with whom he/she has an established personal or business relationship and who he/she believes would be interested in registration for the Service (the “referred customer”). Without limiting the foregoing, the eligible subscriber must not obtain the names for referral from the source other than his/her established personal or business relationships. Violation of this Section 4 will result in the immediate termination of eligible subscriber’s participation in the referral offer and forfeiture of any pending referral offer benefit and/or referral offer benefit previously awarded.
In making a referral under the referral offer, the eligible subscriber, the referred customer agree to be bound by the terms and conditions of the referral offer set out herein.
The referral offer shall be valid from the date of launch of the referral offer i.e. 8th December 2009 (12:00 Hrs GMT) upto 31st March 2020 (12:00 Hrs GMT) (Both days are inclusive) (the “referral offer period”).
The referral offer will be applicable on all registrations towards the Prepaid Service during the referral offer period (the “eligible transaction”).
The referral offer will not be applicable to the recharges during the referral offer period and on registration/recharge done before or after the referral offer period.
On Successful Referral, the eligible subscriber will get the following benefits (the “referral offer benefits”):

The free talktime value is calculated based on the rates for calling to United Sates of America from India using the Service i.e. Rs. 1.69 per minute prevailing at the time of launch of this referral offer. Upon successful registration for the service fulfilling the condition mentioned in clause 9 above, the account of the eligible subscriber and referred customer will be credited with the referral offer benefits and the same will be credited to their account with in 48 hours of such registration.
The eligible subscriber is bound by the terms and conditions of the Reliance Global Call Customer Service Agreement (CSA) as amended from time to time, which the eligible subscriber will agree or has agreed to, at the time of registration for the Service.
All incidental costs, taxes and levies related to the referral offer will be solely borne by the eligible subscribers.
In order to participate in the referral offer, the eligible subscribers shall comply with all such additional requirements as may be required by RCOM.
The completion of the call depends upon various things including but not limited to Network Availability, Third Party Network, Network of the Local Service Provider from where the call is initiated, Network of the Service Provider where the call is terminated, Network Availability at the place of calling party and/or Network availability at the place of call receiving party, and so on. Under no circumstances shall RCOM be held liable for any failure or disruption or disconnection (including early disconnection, pre matured disconnection) of the call, call drop, call not matured, call could not be connected, unable to call the desired destination number, interrupted voice quality, completeness of the call etc. The Prepaid Customers and the Pay After Use Customers hereby agree to indemnify and save RCOM, its affiliates, directors, officers and employees harmless, from any and all losses, claims, liabilities (including legal costs on a full indemnity basis), which may arise directly or indirectly (i) from the use of a Additional Talk Time, (ii) from the breach of any of the obligations, the terms and conditions of this Agreement or any warranties and representations made to RCOM, by the Customers, (iii) as a result of any claims asserted by third parties relating to the Offer. RCOM reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the Customers, in which event the Customers shall cooperate with RCOM, in asserting any available defenses.
Limitation of Liability:
RCOM shall not be liable for any special, direct, indirect, punitive, incidental or consequential damages or any damages whatsoever (including but not limited to damages for loss of profits or savings, business interruption, loss of information), whether in contract, negligence, tort, strict liability or otherwise or any other damages resulting from any of the following:
• the use or the inability to use the Service;
• any defect in the Offer/Service;
• any breach of the terms and conditions hereof.
RCOM reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify the referral offer at its sole discretion as may be required by business requirements or governmental authorities and all such changes shall be binding on the customer without prior communication / notice to eligible subscribers.
The referral offer is neither assignable nor transferable under any circumstances. No substitution, refund nor exchange or redemption for an equivalent cash amount for the referral offer shall be provided under any circumstances. This referral offer cannot be requested / combined with any other referral offer or promotion made by RCOM.
The complaint/claim regarding the referral offer should be made within 15 days of the eligible transaction. No complaint/claim will be accepted and entertained in connection with the referral offer after 15 days of availing the same and RCOM shall not be held responsible for non-acceptance of the complaint/claim.
RCOM shall not be liable for any special, direct, indirect, punitive, incidental or consequential damages or any damages whatsoever (including but not limited to damages for loss of profits or savings, business interruption, loss of information) resulting from the referral offer.
Upon your registration for the Reliance Global Call Service, (i) these terms and conditions will be deemed to be a part of the Reliance Global Call CSA and (ii) you will be bound by the other terms and conditions of the Reliance Global Call CSA.
The decision of RCOM in regard to the referral offer shall be final and binding and is non-contestable.
All disputes shall be subject to the exclusive jurisdiction of the courts located at Mumbai, India for the resolution of all such disputes.
