The human race has always been at war with bacteria, but the development of antibiotics in the 1930s and ’40s gave us the upper hand over the bugs that were killing us. Suddenly we were superhuman. Prior to that, bacterial meningitis had 100% mortality, pneumonia 30% mortality and appendicitis 100% mortality, unless you had surgery.

Antibiotics allowed us to do things that no one could’ve dreamed of doing historically. They’ve allowed us to transplant organs, to undergo chemotherapy, to receive therapy in intensive K-units when we are critically ill. Without antibiotics none of those advances in human medicine would be possible.

We’ve still got the upper edge, clearly antibiotics still work, but it’s the speed of change that concerns scientists. 20 years ago this wasn’t an issue, but today it is. Infectious diseases kill more people than cancer. TB kills 5000 people a day, so if don’t start to act soon within another 20 years we could be in serious trouble.

We’ve deployed our antibiotic defenses far and wide while the bacteria have kept up their counter attack. They’ve adapted and evolved. Now even our last and precious antibiotics are surrendering to the rise of the superbugs.

Now we know that people who return from overseas, after routine surgical procedures are getting superbugs in their bloodstream. With one billion people now travelling the world each year, bacteria are more mobile than ever before and so are superbugs. They’re born when we abuse antibiotics and we’re doing that across the globe. Every time we take an antibiotic we’re giving the bug a chance to become a superbug. If more of us take antibiotics inappropriately the chances are greater that the superbug will come.

Australia is 7th in the world for overuse of antibiotics per capita. Australia is like many of other developed countries. They saw development and wealth equaling ability to use antibiotics, and they lost the plot in terms of realizing that many bacteria will not respond to antibiotics.

It’s the Indian subcontinent which is proving to be a superbug’s perfect petri dish. Antibiotic abuse is rampant there and there’s no antibiotic policy. India mass produces antibiotics, sells them cheaply and the drugs are available over the counter without prescription. Waterways and even the soil are contaminated by waste from antibiotic manufacture. On top of poor sanitation and chronic overcrowding, it’s fertile ground for antibiotic resistance.

There is a general principle in treatment of infections. The more we use any antibiotic the quicker the bacteria are going to become resistant to it. So if we have a situation where antibiotics are used in agriculture, where they’re available over the counter, where in hospitals there is very little control over their use, clearly in that environment there’s going to be a more rapid spread of resistance.

Railways to launch Ticket Booking through SMS

Railways to Launch Ticket Booking through Non-Internet based Mobile Phones with Effect from 1st July 2013
With an aim to further facilitate the passengers, Indian Railways Catering Tourism Corporation (IRCTC),a public Sector Undertaking of the Ministry of Railways, will be launching a pilot project of ticketing through non-internet based mobile phones with effect from 1st July 2013. This will enable people using non-internet based mobile phones to easily access Railway ticketing services through SMS/IVRS/USSD. The scheme is user-friendly, secure and also eco-friendly, as no print out is required.
Indian Railways has continuously endeavored to improve the ease and access of ticketing. The e-ticketing initiative of Indian Railways has been one of the most passenger-friendly initiatives of Indian Railways. In order to further expand the reach of ticketing, the Minister of Railways had made a Budget announcement regarding launch of ticketing through mobile phones was announced in the Railway Budget. The objective was to tap the potential of mobile phone market in India and thereby facilitate the common man, by providing him any-where any-time and hassle free booking option.
The salient features of this new scheme to be operationalised on1st July, 2013 are:
• There will be a dedicated number on which SMS can be sent.
• No need of internet at any stage viz. booking, payment, cancellation etc.
• One has to register the mobile number with IRCTC as well as one’s bank. The Bank (one time password) for authorization of payment.
• The passenger has to type the train number, destination, journey date, class and passenger details like name, age and gender on the SMS box.
• The sender will receive transaction ID and then make payment through sending another SMS by typing PAY followed by the transaction ID, MMID as received from the bank and password.
• On successful booking of ticket, message will be sent to the user by IRCTC which will suffice as valid authority to travel along with photo ID card in original.
• Cancellation of tickets can also be done through the cancellation option available.
• The scheme will be on pilot basis and will not be available during the 8 am – 12 pm for booking ARP/Tatkal/General tickets.

The hot weather, coupled with power cuts, may be affecting diabetics and other patients in ways they are not aware of. Experts say exposure to heat makes insulin ineffective and can break down certain common medicines into compounds that cause stomach ailments and kidney damage.

To counter this, the Delhi Medical Association (DMA) says it has issued an advisory to its member doctors, drug store owners and the common public on proper storage of medicines. Dr K K Kohli, DMA state secretary, said no drug should be exposed to direct sunlight or temperatures higher than 86 degrees Celsius.

“Insulin, certain eye drops and vaccines should be stored in the refrigerator ideally between two to eight degrees Celsius,” said Kohli. He added that certain heat-damaged medicines such as insulin or nitroglycerin, can be life-threatening.

Doctors say certain antibiotics, when decaying, can cause stomach or kidney damage. “Medicines for thyroid problems, birth control pills and drugs that contain hormones are particularly susceptible to temperature changes. These are often protein-based, and when protein gets hot it changes its properties,” Dr Kohli said.

Dr Anoop Misra from Fortis C-Doc Centre of Internal Medicine said he had come across at least two patients in the past fortnight who complained about insulin being ineffective in controlling their sugar levels. “One of the patients was travelling and he had kept the vial in the car. I suggested him to change the insulin vial and within a few days his sugar levels were under control,” he said.

Raj Chawla, owner of pharmacy chain All India Medicos, said prolonged power cuts were a big problem during summers. “Last summer, we had to arrange for six to seven packs of ice every day to store medicines because of erratic power supply. We have not faced any such problem this year,” he said.

Doctors say one should not take any medication that has changed colour or consistency, regardless of expiry date.

What if a cheque bounces?

you will be able to settle the case only out of court

Bounced cheques are one of the most common offences plaguing the financial world. According to the Supreme Court, there are over 40 lakh such pending cases in the country. A cheque can be dishonoured for various reasons, the most common being insufficient funds in the account of the person drawing the cheque, and a mismatch of signatures with the bank records. But what do you do if you land a bad cheque? Here’s a step-by-step guide to the legal recourse that is available to you.

Filing a criminal complaint

When a cheque bounces, the bank issues a ‘cheque return memo’, stating the reasons for non-payment. The holder can resubmit the cheque to the bank within three months of the date on it, if he believes it will be honoured the second time.

The other option would be to prosecute the defaulter legally. The first step is to send a legal notice to the defaulter within 15 days of receiving the cheque return memo. All the relevant facts of the case, including the nature of transaction, amount, date of depositing the instrument in the bank, and subsequent date of dishonouring, should be clearly mentioned in the notice.

If the cheque issuer fails to make a fresh payment within 15 days of receiving the notice, the payee has the right to file a criminal complaint under Section 138 of the Negotiable Instruments Act. However, the complaint should be registered in a magistrate’s court within a month of the expiry of the notice period.

If you fail to file the complaint within this period, your suit will become time-barred and, hence, not be entertained by the court unless you show sufficient and reasonable cause for the delay.

On receiving the complaint, along with an affidavit and relevant paper trail, the court will issue summons and hear the matter. If found guilty, the defaulter can be punished with a prison term of two years and/or a fine, which can be as high as twice the cheque amount.

However, the defaulter can appeal to the sessions court within one month of the date of judgement of the lower court. If a prolonged court battle is not acceptable to both the parties, an out-of-court settlement can be attempted at any point.

“You can also file a case of cheating under Section 420 of the Indian Penal Code, but the above recourse is preferred as it is faster and specially dedicated to this particular offence (bounced cheques),” says Ravi Goenka, advocate, Goenka Law Associates.

Filing a civil suit

While the above-mentioned process is helpful in taking a defaulter to task, it may not always result in recovery of the pending dues.

Hence, one can file a separate civil suit for recovery of the cheque amount, along with the cost borne and the lost interest.

This is where a summary suit under Order 37 of the Code of Civil Procedure (1908) comes in. A summary suit is different from an ordinary suit as it does not give the accused the right to defend himself. Instead, the defendant has to procure permission from the court to do so. However, remember that summary suits can be availed of only in recovery matters, be it promissory notes, bills of exchange or cheques. “Since a summary suit is a civil proceeding that does not have the force of a criminal charge, the chances of imprisonment are remote in such matters,” says Goenka.

Exceptions

These legal remedies are available only where pending debt or liability can be clearly established. Hence, if a bounced cheque was issued as a donation or as a gift, the holder cannot legally sue the defaulter.

Risk faced by defaulters

A jail term or heavy penalty isn’t the only consequence faced by the issuer of a dishonoured cheque. The bank has the right to stop the chequebook facility and close the account for repeat offences of bounced cheques. However, the RBI clearly states that such action can be taken only if the default has taken place at least four times on cheques valued at over 1 crore. Says Aakanksha Joshi, senior associate, Economic Laws Practice: “If the bounced cheque was for repayment of loans, banks also have the collateral offered as security. They are bound to issue a notice before they auction such property to recover the money.” According to her, a bank can also deduct money from the defaulter’s account if there is an explicit contract giving the bank such a right.

Changes in the pipeline

The option of dragging an offender to court under Section 138 of the Negotiable Instruments Act may not be available for long.

If the amendment proposed by an interministerial group—set up last year to look into policy and legislative changes to tackle the large number of pending cases—are accepted, all cases of dishonoured cheques will have to be decided only through arbitration, conciliation or settlement by lok adalats.

If the matter is referred to an arbitrator, the latter will hear both the parties and pass an award binding on both. This can only be appealed on grounds that it is invalid or the defendant was not given adequate time to present the case, or was not given notice about the arbitrator’s appointment.

If the matter is referred for conciliation, a third person has to help the parties come to a settlement. Lok adalats function on similar lines. In both these cases, if the disputing parties are unable to settle, the matter can be taken to court again. Banks, however, are not happy with these developments. “This is a backward step in terms of recovery mechanism,” says Meenakshi A, head, operations, ING Vysya Bank.

Getting a Permanent Account Number (PAN) may not be easy now as the Income Tax department is all set to make the verification process more stringent after some cases of fraud came to its notice. Ration card and rent receipts may no longer be accepted as a proof identity and address, while the tax department may ask for proof of Date of Birth for issuing a PAN card.

Instead of rent receipt, rent agreement along with proof of address of the owner will be accepted. Aadhaar number, gas connection, a certificate issued by the employer in a prescribed format will also be accepted as identity/address proof after changes to the Income Tax Rules are made shortly. The proposed move comes after the Economic Offences Wing (EOW) found that some foreign nationals, particularly from Afghanistan, were using fake PAN cards as proof of identity. In most of these cases, a fake certificate of identity and address signed by a Member of Parliament (MP) was issued.

Finance ministry officials said there are some gaps in the current process and the idea is to make the system fool-proof and robust. A notification to this effect may be issued next week and the new rule would come into effect immediately after that. It will apply only to fresh applicants. As per rule 114 of the Income Tax Rules, depository account statement, bank account statement/passbook, ration card, passport, voter identity card, driving licence, property tax assessment order and a certificate signed by an MP or a member of Legislative Assembly or Municipal Councillor or a Gazetted Officer are accepted as proof of identity as well as address.

“Currently, there is no prescribed format for the certificate issued by these authorities. Now we will prescribe a format for PAN verification and issued of such certificates. It will be similar to the procedure followed in KYC (Know Your Customer),” said an official who did not wish to be identified. Currently, about 14 crore people have a PAN card in India, while only 3.4 crore of them file their income tax return. Many people who don’t file return get a PAN as it works as an identity proof at many places. About 13-14 lakh new PAN cards are issued every year by the tax department and details of just 0.2% applicants (200 per one lakh) are verified by the department.

Officials said in most cases of a fraud people furnished a fake bank account, ration card or certificate issued by a gazette officer. In March 2011, after finding a huge mismatch between the number of PAN holders and the number of tax return filings, the Comptroller & Auditor General had asked the Income Tax Department to ensure that a single taxpayer was not issued multiple cards. As part of the government’s drive against fake PAN, in order to know the genuineness of KYC documents, third party field verification is conducted after allotment of PAN. The information of failed KYC verification is made available to field formations of department to mark the event in respect of PAN as ‘Fake’ through Assessee Information System application software.

Of the total PAN allotment, more than 96% PAN allotments are under the category of ‘Individual’ applicants and maximum fake/duplicates are also observed under this category. For uniquely identifying the PAN allotted and to overcome the problems of fake PANs, issue of more than one PAN to an individual and to clean up the PAN database duplicates, capturing of Aadhaar in revised PAN application from 49A has been started on voluntary basis. About 3,04,452 unique Aadhaar numbers have been seeded/incorporated into PAN database.
