11. In the event orders are cancelled during or outside the offer period, the corresponding cashback value applied on that transaction will not be refunded.
12. In case of partial cancellation, complete cashback amount would be recalled and the customer would not be entitled for cashback.
13. The cashback amount for a transaction cannot be combined with or transferred or assigned to any other transaction.
14. If the customer doesn’t receive the cashback amount, he/she can claim for the same within 3 months from the order date. In the event the Cardholder fails to do so, he/she will not be eligible for the cashback amount.
15. LeEco in no event shall be liable for any incidental, consequential and financial losses in any event whatsoever.
16. HDFC Bank and LeEco reserve the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this offer or not, or to extend or withdraw it altogether.
17. For any card related claims, the Cardholder shall approach the Bank and LeEco shall not entertain any such claims.
18. LeEco shall not be liable for any claims or grievances’ solely attributable to the Bank.
19. LeEco shall not be liable for any claims arising due to Force Majeure events or situations beyond LeEco’s reasonable control.
20. Any disputes, disagreements etc., by whatever name called and arising out of or in connection with this Agreement, including any question regarding its existence, validity or termination, shall, if not amicably resolved within 15 (fifteen) business days (from the date a party receives a notice from the other party stating its intent to amicably resolve the dispute), be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation # Act, 1996. The seat/place of arbitration as well as the venue of arbitration shall be Bangalore, India. Further, the language to be used in arbitration shall be English.
21. In no event, the entire liability of LeEco for any dispute arising in connection with this offer shall exceed the cashback amount, a Cardholder is entitled to under the said offer.

Offer 2: No Cost 6 Month EMI on Le 2 and Le Max2

Important Terms and Conditions

1. 6 Months ‘No Extra Cost’ option (“Offer”) is applicable on purchase of Le2 & Le Max2 phones on www.lemall....in (“Website”)
2. The Offer is valid from August 30, 2016 (15:00 Hours) to September 1, 2016 (23:59 Hours), (Offer Period)
3. The Offer is available only for select HDFC Bank credit cards issued in India. This Offer is not valid for other cards issued by HDFC, including but not limited to Corporate Credit Cards, Purchase Credit Cards and Commercial Credit cards.
4. In this Offer, customers holding valid HDFC credit cards will be eligible for purchasing Le2 and Le Max2 phones on the Website by making payment in easy instalments of six (6) months at no extra cost.
5. Please note that where a customer selects the EMI option by using a credit card which is not eligible under this Offer, the customer shall be liable to bear the interest, processing fee and other charges which may be levied by the concerned issuing bank. LeMall will have no liability whatsoever in this regard.
6. Upon successful completion of a transaction, customer shall not be allowed to change the tenure of the EMI.
7. The credit limit on the customer’s HDFC Bank credit card shall be blocked to the extent of the full transaction amount. The credit limit will be released as and when the EMI is billed and paid for in subsequent months as per the EMI plan. Payment of EMI shall be done in accordance with the terms and conditions laid down by HDFC Bank.
8. All prevailing terms and conditions of merchants would apply in addition to these terms and conditions.
9. Approval of EMI under this Offer is at the sole discretion of HDFC Bank and LeMall disclaims any liability in relation thereof.
10. Any query/dispute arising out of or in connection with payment of EMI under this Offer shall be settled directly between the customer and HDFC Bank, and LeMall and/or merchants shall not be liable for the same in any manner whatsoever.
11. This Offer cannot be clubbed with any other scheme/offer which may be made by HDFC Bank, including but not limited to the 10% cashback offer.

Other Terms and Conditions

1. HDFC Bank does not hold any warranty or make any representation with respect to the availability, delivery, quality, merchantability or suitability of the services to be rendered by merchants under this Offer and HDFC Bank shall not be held liable for the same in any manner whatsoever.
2. Any tax applicable from time to time as notified by the Central/State Government, is applicable on all fees, interest and other charges and is subject to change as per relevant regulations of the Central/State Government.
3. LeMall and HDFC Bank and reserve the absolute right to add, modify, change or vary all or any of these terms and conditions or replace, wholly or in part, this Offer by any other scheme, whether similar to this Offer or not or to withdraw it altogether, without prior notice.
