UPI Cashback Offer Terms and Conditions

This (“Offer”) is provided to you by Xiaomi Technology India Private Limited (“Xiaomi” or “we” or “our”).
Please read these terms and conditions (“T&Cs”) before participating in the Offer. By participating in the Offer, you agree to be bound by these T&Cs, our User Agreement and Privacy Policy, as set out on our website www....om, and the related mobile application and/or mobile website (collectively “mi.com”).
You can participate in the Offer only if you:
a. can form legally binding contracts under Indian Contract Act, 1872;
b. are residing in India;
c. are a registered user on mi.com; and
d. possess proof of age, identity and place of residence.
You acknowledge and agree that you satisfy all Offer eligibility requirements as set out below.
The Offer is valid during mentioned offer dates, both days inclusive (“Offer Period”), unless extended or withdrawn by Xiaomi at its sole discretion.
If you purchase any of the following products (each an “Eligible Product”) from mi.com during the Offer Period using the Unified Payment Interface (UPI) payment option (“UPI Payment”) you shall receive the corresponding cashback as set out in the table below (“Cashback”):

It is clarified that you will not be eligible to receive cashback under this Offer if the payment is made using any payment method other than UPI Payment.
The Cashback, under this Offer, will be credited directly to the account from which the transaction was made. All Cashbacks shall be credited within ninety (90) days from the date of delivery of the Eligible Product to the delivery address provided by you on mi.com.
All government levies and taxes shall be payable by you as applicable at the time the Offer is availed.
You will not be eligible to receive cashback under the Offer, if the transaction: (a) is cancelled (for any reason whatsoever); or (b) the transaction fails (for any reason whatsoever). Returned transactions, disputed or unauthorized/fraudulent transactions will not be considered for the Offer.
Standard manufacturer’s warranty as set out in mi.com shall apply to all Eligible Products purchased under the Offer.
Xiaomi shall in no way be liable if you are unable to/ fail to complete the transaction due to incompatible mobile phone handsets, telecom usage plans, network or system failure or for any other reason whatsoever.
Nothing herein amounts to a commitment by Xiaomi to conduct further, similar or other offers.
These T&Cs are in addition to User Agreement and Privacy Policy available on mi.com. To the extent the User Agreement or the Privacy Policy is inconsistent with these T&Cs, these T&Cs shall prevail with respect to the Offer only.
You shall be solely responsible to adhere to the T&Cs while participating in and availing this Offer.
The Offer cannot be combined with any other offer.
This Offer is non-encashable, non-extendable and non-negotiable.
Any issue with the Offer will only be entertained only till fourteen (14) days after the end of the Offer Period. Post such date, Xiaomi will not entertain any correspondence or communication regarding this Offer from any persons.
Pictures of products advertised on the website are representative only and may not bear a resemblance to the actual products. Xiaomi shall not under any circumstances be responsible towards the same.
You are not bound in any way to participate in the Offer. Any such participation is voluntary and you may choose any other mode of payment for purchase of the Eligible products.
This Offer shall be subject to all applicable laws, rules and regulations which are in existence and which may be promulgated anytime by any statutory authority.
Failure by Xiaomi to enforce any of the T&Cs in any instance shall not be deemed to be a waiver of these T&Cs and shall not give rise to any claim by any person.
Xiaomi reserves the right to alter, modify or cancel any T&Cs herein, or modify, terminate or withdraw the Offer at any time during the Offer Period at its sole discretion without prior notice or assigning any reason thereof.
Xiaomi retains the right to contact the participants any time after the expiry of the Offer.
This Offer shall be governed by the laws of India. All disputes with respect to this Offer shall be subject to the exclusive jurisdiction of the courts in Bengaluru, India.
XIAOMI DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, AND NON-INFRINGEMENT OF THIRD PARTY INTELLECTUAL PROPERTY RIGHTS. UNDER NO CIRCUMSTANCES, WILL XIAOMI OR ANY OF ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR CONTRACTORS SHALL BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY LOSSES OR DAMAGES ARISING FROM THE OFFER, UNDER TORT, COMMON LAW OR UNDER PUBLIC POLICY, EVEN IF SUCH PARTICIPANT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
