Hi Friends,

I am stuck in an annoying issue. Before lockdown, I wanted to do some furniture work, after the initial assessment, I gave 35k as advance to a carpenter for material procurement. After a few days, the lockdown started and later he moved to Bihar. After hundreds of calls, I spoke with him but he says don't have money to return and now he is not lifting my phone. I transferred him 35k from my account which I have screenshot. 

I met the police but they were not entertaining. Is there any way to recover my money?

Even if you have proof of screenshot , once transferred to another person account PERSONAL ACCOUNT, thats it, you can't file case against it, because the carpenter can lie that he gave you something as service for that amount, as well you will have to shed more than 35k for court and bribing the police lol , just ask that carpenter to work for you, thats the only way, as he can't return money he can work for you, (hopefully he returns to your home place to do work) or make him do some work at your friends place at bihar maybe

This case would be different for Business Account (i.e Current Account) though, as you can file case in consumer court and claim easily, but for carpenter personal account nothing can be done as far as i know

No way of recovering money directly.

Depending on intellectual level of the person on the other side you need someone to pretend as a police officer and threaten him to return your money. If you have someone known in police who can do this then it's even better.

If that carpenter is an honest person then your plan to recover money by getting them to work for you, might work. But I don't think that's the case. Otherwise he would have offered to pay in small amounts. 


If that total labour cost isn't more than twice or twice of that amount he wouldn't accept to work, as he'd be working for free ( without any new earnings opportunity)

Everything depends upon the goodwill of the carpenter...

otherwise no way to recover, forget about the money. I know it's hard but you have to accept the fact that money is not coming back if he is not willing to return

Just file a online police complaint. And they will do needful.

Maybe you can try calling 1930 and complain.. They'll not refund you directly but put a lien in his account which you won't get unless he goes to bank to submit a debit consent, or you file a case against him then court will get refund.

But first you'll need convince 1930 cell somehow that why it took you 4 years to realize this!!!

I have lost Rs 1200 to a watchman. After a while, it is not worth your time trying to recover. Like a bank, you should be willing to 'write-off' and more importantly learn from your mistakes.

@suhamaha305 did that carpenter ever verbally abuse you or threatened you? You can lodge a police complaint by sending your written complaint through Post to deputy commissioner of police of the place where you live and where that carpenter lives.


But to recover money you need to file a civil suite, which is going to be lot more than 35k.

Here are few golden rules for any future ( renovation)  work you get done.

1) Don't  Pay in advance  more money than  what you're willing to take risk of loosing.


Always ask them to send you a (price) quotation for the work ( with details of the work) through WhatsApp or SMS message with their  bank details


2) Try to buy most of the raw materials ( woods, plywoods, paint, fittings etc)  yourself from the store pay them some advance they'll deliver to your doorstep. That way you don't  get  cheated by contactor for materials,  both in terms of price and quality.

3) Always compared prices of Both labour and materials from different sources.
