Guys I had ordered a product x but received product y. Since product y I have received is of high value, can I request flipkart to refund me amount without returning y?

Note: please don't teach me ethics and values, I'm just asking if this is legally possible?

Don't be so greedy. You want to keep the higher value phone and get a refund too? Just think you got a better deal. If you have contacted them about this and after that they noticed it, it was a stupid thing to do.

But if they found out themselves (or even if they now know because you wanted to be smart and informed them) and are asking to return just tell them it was a gift for someone and you don't have access to the product anymore. They might just accept it and move on or they will block IMEI.

Also I read somewhere that online stores can't force you to return an item without ur permission.. So just asked if it's possible..

So someday I will come to your mobile shop, ask for Nokia 1600, and by mistake you gave me iPhone max pro. So, now I am eligible to keep iPhone and I will ask for a refund also because you never gave me Nokia 1600, also you can't ask back your iPhone because I read somewhere that no one can force you to give something.

I read this story somewhere, and hope you can relate -

Depends on category of products, if product is returnable, flipkart will ask to return the product for refund

Otherwise refund would come directly. But account health would be affected

If Product is Non Returnable they will initiate refund.

If Product is Returnable then they will take back product and refund.

If their system has found it, then they can proceed legally, though most likely they wont.

You shouldn't. As you said, Flipkart acknowledged the error in delivery, and they'll void the order by releasing the refund to the original mode of payment.

Also, I read somewhere that online stores can't force you to return an item without ur permission

I don't know the rulebook, but practically they can't return the high-priced product from the customer in the real world. If you're keeping the order, you agree to settle with it.

Vendor gave you 20 apple

So according to you

You should get 10 apple refund and 20 apple free..

Time to leave the earth.

People here be living in fairy world. They believe in ethics and values, but don't understand what these big e-commerce companies have done with small retailers..

Anyways I'm talking about technical and legal aspect not your fairy worlds

You ordered a phone but got "better" phone or "more" phone.

So 10 apples vs 10 imported apples is a better comparison. Even 20 apples is better than your 20 bananas example.

Yes, you definitely deserve a refund. It's fine if you want refund+ compensation. But refund + product too?

I guess if you keep the phone the small retailer you are speaking about will be affected. As the phone belongs to the small retailer only no?

If its a mobile, then most probably it was sold by a big in house seller

If you decide to keep the product, then e-comm partner got the right to reject refund too?

After-all this is no pizza delivery, u get to keep if/when the delivery person shows up late

That's what I'm asking. Afaik they can't force return the product. And since it's not what I have received I deserve a refund..

But I haven't got any solid answer from anyone except fairy worldssss

They cannot force you to return a delivered product (Pretty sure about this) but you're bound to return/reject wrong deliveries (Product / Quantity)?
No idea if there are separate terms for e-commerce sales but this is what i found under general "Sale of goods act" (+ this varies as per e-commerce terms)
Delivery of wrong quantity -
Where the seller delivers to the buyer the goods he contracted to sell mixed with goods of a different description not included in the contract, the buyer may accept the goods which are in accordance with the contract and reject the rest, or may reject the whole.

Yes, you can ask for a refund as you got the wrong product, and you can also keep the wrong product with you. I can suggest more options, after getting a refund you can file a complaint for mental harassment and wasting your time. Take them in court, you can settle in millions if not in billions. Keep us posted.
