Please help us in showing Mobikwik, what dimers are capable of doing.
Mobikwik took back 300 cashback on 300(Add Money) offer for Lumia devices recently.
It was a offer from Microsoft where a person having a Lumia device was entitled to Rs.300 cashback on Add Money Transaction of Rs.300 at Mobikwik. The offer was valid for a period of 12 months. The offer started in the month of August but was applicable to all those people who buy and register/login to their Mobikwik account from their Lumia device before Nov. 15. Seeing the offer of Rs.300 for a period of 12 months many people bought Lumia phones. But mobikwik initially paused he offer for a few days in December, then in the month of January people had contact via Facebook to get their cashback. In the month of February they provided unique codes till 15th of February and after that they are now saying that they have the right to take back the offer at anytime. This is a clear cut Fraud where they took money from Microsoft to increase the number of users of Mobikwik but later did not deliver their promise.
So I request all of you who have faced this problem please sign the petition and share the petition over FB,twitter,whatsapp wherever possible using hashtag #MobikwikLumiaFraud

I guess you read too much into their T&Cs and just because they decided to add that condition doesn’t mean they can escape the law. Those withdrawal T&Cs only apply to offers they provide for upfront purchases and they are always free to do that. But here they have made false promises to sell a product and those conditions will be thrown out in the first instance. Here Microsoft would have to pay the damages if someone this to court.

When a offer is started they have rights to step back the offer so if somebody availed the offer its good for him and if somebody failed he was just unlucky. But in this case they force us to buy useless dumb mobile with this precious offer and the best part is this offer cost 12 months and they withdraw the offer just in 3 now thinks rationally you will found intention of fraud before this all started. It was a part of the plan with two big company’s.

Bro why most peoples favour mobikwik for last tc.Their first tc is that its valid for 300*12, by last tc means ,mobikwik can withdraw offer any times means before l15-Nov 15,but once offer started by user they are eligible for 12 month.so don’t contradicts first and last tc.

Rightly put.. Question is not of Rs 300 or 3600, its about Mobikwik withdrawing the offer without any valid reason. Terms & Conditions are there, but this doesn’t mean you will treat the customer as per your whims and fancies… The objective of T&C is not to get god-like power and do whatever you wish for. Even if a customer has agreed to T&Cs, doesn’t mean that company has got ultimate authority to take any decision… they are still answerable for their actions.
Personally speaking, to me this appears as a serious breach of the unsaid trust that every company must maintain towards its customers. They should better get their act (policies and systems) right rather than harassing the customers. I would rate Mobikwik as one of the most unethical payment gateway system in whole Indian e-commerce ecosystem.

Those who think that if a company has written that they can withdraw the offer time and then they actually goes on to withdraw the offer, goes in company’s favor need to read some common cases in consumer forum. Court does not takes decision strictly on the basis of written bullet points of T&Cs. T&Cs of a company’s offer are not law… they are just broad guidelines and cannot be above law.
So, if you feel that any action by any company is unjust, and doesn’t have any valid reason or is weak on the grounds of practically necessary or results in widespread customer harassment, then trust me company must have to offer due compensation to the harassed customers.
Letme share a case of some ICICI bank loan customer. That guy had some vehicle loan from ICICI and like all loan processes he also had signed lots of documents of T&Cs. Well at the time of payment of his final EMI, which was of few thousands, he rounded off the payment amount to lower decimal number thus ending up paying a few paisa less than final EMI’s amount. After that he thought that he is free from vehicle loan liability. But ICICI bank instead of closing his loan account, started penalizing him month after month for that 60 paisa due amount. And also started sending his threat/recovery letters (registered posts) for payment of due amount. That guy took the matter to court, and at that time due amount was Rs 10,000+. The court said that the Bank has set a ridiculous example of Stupidity and apathy towards customers.. And told bank that instead of sending the customer all those reminders, bank could have easily topped up the account of customer by those rupees. Verdict was court asked bank to pay the customer a harassment compensation of 10k and a penalty of around Rs 1 lakh.
Its a 3-4 year old news, so not sure of exact numbers, but more or less the message is same.
So, the point is courts consider T&Cs, just as an argument and then also check if stating those T&Cs was also correct in first place. And the decision is taken on the basis of righteousness… not on the basis of some signatures and acceptance made on a piece of paper.
