TRAI Guidelines on SIM Card Deactivation

The Regulations inter-alia mandate that in case a TSP puts in place any mechanism for deactivation Cellular
Mobile Telephone Connections due to non-usage, then he has to abide by the following regulatory guidelines :-

(i) The mobile connections of prepaid consumers shall not be deactivated for
any period of non-usage less than 90 days;

(ii) For the purpose of usage, a voice call/ video call (incoming or outgoing) or an
outgoing SMS or a data usage or usage of Value Added Services, or payment
of rental (in case of post paid connection) etc. shall definitely fall in the scope
of activity, the service provider may prescribe any other activity as well;

(iii) There shall be no deactivation if the balance in prepaid consumer account is
Rs.20/- or more;

(iv) An ‘Automatic Number Retention Scheme’ shall be implemented for prepaid
consumers on payment of reasonable charges;

(v) A consumer whose connection is deactivated shall be given a grace period of
15 days within which he can reactivate the same number;

(vi) Consumers shall be transparently communicated the terms and conditions of
deactivation of SIMs due to non-usage.

The Regulations also mandate implementation of a ‘Safe Custody Scheme’ for postpaid consumers on payment of a reasonable charge. Such consumers will not be required to pay monthly rental during the period of safe custody;

Can anyone clarify if one has more than Rs. 20 but still doesn’t use phone for more than 90 days, it still cannot be deactivated.

If the operator does deactivate your no. TRAI for certain won’t help you. Real life experiences of dimers have been a little different.

Outgoing sms should be chargeble or toll free 121 will also be count ?

IIRC @syed786 had 1600+ balance in his Jio no. when it was deactivated.

i had 30 rs in docomo sim ( when it moved to airtel) and then it was deactivated

so dont think 20 rs will work laughing

Jio doesn’t stopped INCOMING CALLING so,better to do incoming call or INCOMING SMS to that Jio Number within 90 days,which hasn’t been recharged from a Long time ,that’s the fantastic solution.

Other Operators doesn’t allow INCOMING CALLING AFTER CERTAIN DAYS,SO CANT COMMENT ON THAT!

But,I have Jio SIM and I am managing it from Last 4 years and I do like that no one has been deactivated my sim like that,also Dont do any Promotional activity or call more than 100 Numbers from a SINGLE SIM ,that’s why They have blocked the sim without notification because you breached some of the laws and if your number is deactivated you have 15 days of GRACE PERIOD and also you can complained to TRAI that Operator DEACTIVATED YOUR SIM without Any Reason.,just follow the rules and conditions and every thing will be in your favour.

I am having 4 SIM BSNL,JIO,VI and Airtel all I am managing and not a single sim has been deactivated till now from last 4 years and I recharged only 1 sim and bsnl is 107Rs per 84 days so my cost is for only 1 sim and after that I stopped using 1 sim and switched to 2nd sim maybe airtel or vi depending on the service,speed ,etc so no issue and Jio is my backup

The sim might be under doubtful activity noticed which may have fall under misuse of telecom service. Like too many connection on one identity.

The retention rule says if balance is more than Rs.20, operators are free to deduct it and extend validity by 30 days. If there is no balance give 15 days and intimate via sms. If balance is like Rs.100 then they can extend upto 5 months + 15 days but the thing is most operators aren’t following it as they don’t deactivate even if balance is zero.

Some customers complaint that they deactivate suddenly. Actually they never deactivate suddenly. If you sim has no balance for 90 days you are bound to lose number. Now it is on operator when they deactivate. Why to complain after losing number when you yourself taking risk of losing it by non-usage, In that matter you can’t even appeal. Now what I do is keep playing by rules and never faced disconnection issue in life.

Those who lost their number even after having balance might be under some kind of scrutiny where company found irregularities with customer or pattern of usage like some use their no. for calling too many numbers. So when they audit the pattern which is as per their wish they can close it.

The notification help you fight legally. No matter from which year it is. You can challenge TRAI but we have more of sore loser here who barb like anything and do nothing on ground. If any company do anything to me which don’t go by rules, I hit them hard, too hard. Made Airtel pay Rs.5 Lakh in consumer forum in year 2010 for fradulently duping customers in name of VAS.

The thing is even if they are active and company can deactivate any time. If you have made usage in last 90 days or had balance, you can make a case else can’t complain against them.

As far as Docomo number is concerened do you upgraded to Airtel 4G after meger. I had Docomo sim too. Took 4G upgrade sim for free from local store and sent sms. My Docomo number migrated to Airtel 4G sim in 30 mins. After that no rec for months but had Rs.50. They deducted it made it zero but I noticed and recharged it. Maybe they made zero balance in your sim and then deactivated. If you take out sim and it’s remains in no network zone for 90 days, you are bound to lose.

I checked that sim before 15 or 20 days before its deactivation and at that tym it had 20rs balance
After ur comment i tried to call those numbers and now they are showing switched off.. 🤯🤯🤯

After seeing your fighting spirit, I want to ask one thing of course it’s a little bit off topic of this thread. When due to some miscalculation I missed to pay 1000/- within time out of total bill of 169000/- the Axis Bank charged me 10000/- and my repeated request for waive off didn’t yield anything. And the same Axis Bank made a 3 months delay in crediting my reward points that too only after several follow ups and writing upto Nodal level. So can I take any action to seek compensation for their inefficient service. Why I am asking because for the simple 7 days delay in 1000/- payment they charged 10000/- brutelessly then why shall I leave them when they made 90 days delay in crediting my thousands of rewards points. Due to that abnormal delay in rewards points posting I stopped using the card those 90 days due to the uncertainty and thereby I missed the opportunity of accumulating more reward points and also failed to meet the target spend to get annual fee waive off. It’s a collosal loss to me due to their deficiency in service. So seeking your opinion and guidance.

15-20 days before. That’s enough time. So may be they deducted Rs.20 gave 15 days and then deactivated. The thing is when you didn’t used the number for long, they can close it anytime. We can fight legally only if we can prove company wrong. Yes if there was a use of service by you in less than 60/90 days as in some cases operator like Idea used to SMS me that use your number every 60 days to enjoy continuity of service. RCOM also published 60 days rule on website but later TRAI fixed 90 days.

Rules are mentioned for both loans/credit card payment. There is nothing like just 7 days ot just 1 days. If you are crossing due date, you are charged because there is a slab mentioned for fine. In case of reward points delay there is no compensation mentioned and we agree to TnC by them. Every bank use terms that benefits them. Like HDFC clearly mention that there can be delay but the thing is RBI hasn’t charted any fine in case of reward points delay. Yes, there is inefficiency but there is nothing mentioned in name of compensation and RBI also can’t take action for such things. There is also a timeline of max. 30 days after 90 days where you can report. This sytem runs automatically and 95 out of 100 customers get on right time and for 5, banks can only issue apology in email.

People only complain when get late or less. There are many a times when people get extra but they never call/email bank that their rightful cashback/rp was less and please deduct extra you gave us.

Vi continues to send such messages even in those nos. that are in active use almost always. It seems to be sent en masse.
