Please note that I made a purchase of Samsung Galaxy core 2 , 4G white (Unboxed) on 05th February 2016, the product was delivered to me on 08th February 2016, since I have not opened the box containing the mobile handset then and there but when I open the box after 3 days of product delivered I found that the aforesaid mobile handset was not properly working and their were defects,
when I lodged complaint with the Infibeam through email and phones they informed me that the defective product is returnable only within 72 hours of delivery as per their return policy and in my case since the 72 hours has been passed so they shall not take back the defective product and further advised me that the product bore 6 months warranty so better contact the Samsung Service centre to get the handset restore to original condition,
that 02nd April 2016 I myself went to Samsung Service centre lying and situated at 41, A .J.C Bose Road, Kolkata-700017,I was shocked to learned from the service centre executive that this handset is question is not unboxed handset but previously repaired handset, and this handset prior to sold out to me under impression unboxed handset by Infibeam was repeatedly repaired by the Samsung india, and for these type of repaired and/or defective handset Samsung do not offer warranty at all for a single day
In this respect I am confident , the Infibeam, its Chief executive Officer, founder, owner and the concerned staff and authorities are guilty of criminal conspiracy, cheating, misappropriation, breach of trust, and unfair trade practising defrauding the bonafide customer.
When i did not recived any assurance of return of this handset I have lodged FIR, with the Commissioner Of police, Kolkata, Ministry Of Corporate Affairs, and the O/C Cyber crime, Kolkata Police Headquarter, please go to attachment and find the details and scan copy of my submitted complaint on the basis of such a case started

This is to inform you that being encouraged with the item description, and assurance given by the online consumer goods ratailer Infibeam.com , I made a purchase of Samsung Galaxy core 2 , 4G white (Unboxed) on 05th February 2016, the product was delivered to me on 08th February 2016, since I have not opened the box containing the mobile handset then and there but when I open the box after 3 days of product delivered I found that the aforesaid mobile handset was not properly working and their were defects,

Please further note that when I lodged complaint with the Infibeam through email and phones they informed me that the defective product is returnable only within 72 hours of delivery as per their return policy and in my case since the 72 hours has been passed so they shall not take back the defective product and further advised me that the product bore 6 months warranty so better contact the Samsung Service centre to get the handset restore to original condition,

Please further note that I am a senior counsel to the Central Government, under the Ministry Of Science and Technology, and mostly indulged in professional career, and activities and due to lack of time could not visit Service Centre immediately and kept my handset in box and unusable condition and on 15th March 2016 when I sent the product to the Samsung Service Centre to restoration But the service Centre refused to service the handset. It is pertinent to mention that 02nd April 2016 I myself went to Samsung Service centre lying and situated at 41, A .J.C Bose Road, Kolkata-700017,I was shocked to learned from the service centre executive that this handset is question is not unboxed handset but previously repaired handset, and this handset prior to sold out to me under impression unboxed handset by Infibeam was repeatedly repaired by the Samsung india, and for these type of repaired and/or defective handset Samsung do not offer warranty at all for a single day. I would like to bring into your knowledge that the Infibeam has listed this handset as “UNBOXED” Unboxed means that the item was returned to the seller (for reasons such as wrong model dispatched, etc). This item was either opened by the customer who found the wrong product shipped or by the seller to check the contents of the package. This item is as good as new, comes with all the original box and accessories, and a Manufacturer Warranty (although very likely for a shorter timeframe). Further note that while selling the product I have gone through the details mentioned about the handset ,warranty, etc and also called the Infibeam helpline the Infebeam executive has assured me that this handset is as good as new, only BOXOPENED, and not repaired or refurbished. But when I saw the packing of handset the box was mutilated, and contained few stickers of Infibeam and some known vendors, still I was confident and kept my trust upon the Infebeam but when the handset does not work properly I tried to returned it which was refused by the Infebeam, and now the Samsung Service Centre and confirmed that the handset was repeatedly repaired In view of above fact and circumstances , the Infibeam, its Chief executive Officer, founder, owner and the concerned staff and authorities are guilty of criminal conspiracy, cheating, misappropriation, breach of trust, and unfair trade practicing defrauding the bonafide customer. I therefore request you to treat this letter as FIR, go through the material and handset sold by the Infibeam, and investigate the case thoroughly so that the bonafide consumer are not cheated and their fund are misappropriated by these online retailers. your faithfully

Appreciate if you have really filed FIR, and police accepted so easily. I still can not believe.
You will get refund from infibeam in any case as they are Ltd company hence will not risk FIR.
Also has lots of cash (raised through IPO) for the time being.

It would have been if u checked mobile within 72 hrs as per their policy.
It may be possible that one may not find faults in just 3 days.
