Help me fight against a fraud buyer on eBay (i sold my iPhone and got cheated)

Hey dimers,

I need your help in tackling a fraud buyer on eBay. Here is what happened

I sold my iPhone 6S Plus 128gb on eBay to a buyer in Pune on 18th March 2016, got an email from eBay saying the payment is under verification and I need to ship the phone after the verification.

On 19th March 2016 I got an email from eBay saying the payment has been verified and I can ship the phone. I formatted the entire phone and sent it by courier with insurance on 19th March 2016.

The courier got delivered on 21st March 2016 and the buyer didn’t confirm the item even after sending him messages for 2 days.

Today, on 23rd March 2016, he raised a refund request on eBay saying the phone is defective! I sent him a perfectly working phone that is as good as new and now he says that they phone isn’t working and raised a claim.

How do I tackle this? Anyone has any experience in tackling such buyers on eBay? Please help me dimers.

Yeah he sent a valid invoice copy he got from Amazon. Still ebay refused saying invoices are non-transferable. They told him that if he can get an invoice in the buyer’s name they can consider it. But amazon refused to issue another invoice with the changed name. So he just left it at that and only sells locally if he has to.

As the buyer agreed to all the conditions of the listing, he cannot raise a claim
In the case of used items, it doesnt matter anyways

Oh yes we could have done that. Missed it out, in fact we could have edited amazon invoice itself as they would have provided a pdf if we asked for it.

@raghupro You should definitely remember this if the seller tries to get smart saying non-transferable and stuff. Just tell ebay that you can get the invoice transferred to the sellers name or just make sure you cleverly mask your name on the invoice. Just tell them its an open invoice with serial/Imei and anyone can claim warranty.

Sure will do. Moreover, Apple doesn’t care about invoice/bill etc. All the want is the serial number of the device to check in their database.

even I once faced a problem similar to this
Buyer was very clever and somehow managed to get the courier held up at the local office for a few days

Masking names on invoice is a bad idea
For used mobiles, there won’t be any such thing like invoice on buyers name

In fact even for new mobiles there won’t be any such issue. When I joined eBay in April 2015, I sold 3 mobiles which I won from various Twitter contests and events.
eBay flagged my account and asked me for source, I had to send them Twitter messages and Bloggers mind invoices to [email protected]
Obviously everything is under my name
Guess what my account got unblocked within a day or two with apologies from eBay

So I got call from the claims officer. Explained him the whole scenario. In the asked him to request the buyer to furnish a service report from Apple that has the serial number mentioned on it.

Also made a request to ensure that his payment is kept on hold until my phone reaches me in case I loose the case and he returns the phone to me.

I told the claims officer that I will ensure to record a video right from the moment the courier guy reaches my doorstep until I am ensured that it is my phone that was sent back to me.

Back home and here is the update.

I got a call from the claims department (Mr. X). Luckily X was quite well versed with the issue and was very patient in listening to my side of the story.

From what I understand from X it seems the buyer said I sent a dead phone and no invoice too. I told X that I emailed the invoice to the buyer and asked him to check his emails, I actually sent the invoice to eBay as well for reference so asked X to check the emails received from my registered email ID.

I explained complete story on how iCloud works and I have a proof that I disabled iCloud on day of dispatching courier and the other proof I had, which I already sent to eBay too.

I told X that as the phone is under Indian warranty he can walk into any apple store with the phone even if he doesn’t have the invoice and get it rectified there. In case the phone is dead I need a service report with the serial number of the device clearly mentioned in the service report. I later got an update in the claims page that X actually communicated this with the buyer and gave him a time frame of 72 hours to furnish the proof else he will close the case.

In the end I made one request. I told X that even if the transaction is reversed and the buyers ships back the phone to me I have no issue at all but at the same time I asked X to not issue a refund until the phone reaches me and I verify that it is my phone. I told X that from the moment the courier guy reaches my home and till I verify the serial number on the back of the device (or inside if it powers on) I will record the video and send it as a proof if there is any issue. Mr. X seems to have obliged and said that he will definitely ensure that refund is not processed till the phone reaches me and I confirm.

no bro now ebay got very smart ,
he may disable the buyer account if found guilty .
In this case ebay will ask some pics from the buyer and will check them , they will call the seller , the seller can contradict that the phn i send is correctly working .
same thing happened with me , the seller send me defective battery , after 3 months of regular calling to ebay , they refunded me but after few days again called me to send the battery back to seller and i send it .

If you sell used good >> Always prefer OLX/QUIKR

This was one thing I wasn’t aware of man, I should have been more careful. Anyways, let me be patient for a few more days and see how things will turn out to be.

Update:

The claim made by the buyer as been rejected as he did not provide any proof that the phone I sent was not working even after extending the deadline twice.

The buyer never confirmed that the product has been received by him on eBay so I have to wait for 2 more days for auto confirmation of the shipment receipt and then to initiate the payment process.

The purchase got auto confirmed on eBay today morning but the remittance details are yet to be updated in Account Balance in My PaisaPay. Looks like the transaction is almost successful, fingers crossed!
