A consumer court in Punjab has slapped a fine of Rs 10,000 on Snapdeal and ordered them to deliver what they had initially promised: iPhone for Rs 68.
The Case
Nikhil Bansal, a BTech Student at Punjabi University saw a listing of an iPhone 5S 16 GB (Gold) on Snapdeal, which was priced Rs 68. On February 12th, he ordered the phone, and started waiting anxiously for such an awesome, cheap deal.
But as it so often happens on ecommerce portals, the order was cancelled and Nikhil never received that iPhone.
But unlike other shoppers, he refused to be silent.
He approached the district consumer forum in Sangrur district of Punjab, and filed a complaint after Snapdeal refused to ‘honor the deal’. The forum passed the judgment in favor of Nikhil, and Snapdeal was ordered to deliver the iPhone at the same rate in which it was initially promised: Rs 68.
Besides, the forum also ordered Snapdeal to pay Rs 2000 as penalty.
However, Snapdeal appealed in the consumer forum against this decision, and decided to fight the case. But again, they lost, as the forum now ordered them to pay a fine of Rs 10,000 to close the case.
This penalty needs to be deposited in consumer welfare fund.

Most importantly is the harassment we face after placing order.
Calling cc explaining same issue to each time and again and again and at the end we get A BIG THULLU as they exit the issue by saying ITS WAS JUST TECHNICAL GLITCH
So if u drag anyone then drag it till the end.
Nothing new , our laws are outdated and thus consumer always wins

Lawyer to nahi huin but thoda law padha hai , in these situations 90% chances are there consumer will be winner Furthermore if it clearly mentioned that seller should win but for small amounts like T Shirt or something else consumer would be the winner
if you guys think to sue for compensation or delivery of that item , then be remember amazon techfone price error which was biggest in india and lasted long until the stock of mobiles was out , so everybody will sue for the same . and i dont think amazon will bear such loss at any day .

Amazon writes in their T&c…..“we reserve the right to cancel any transaction in case of any mishappening.”

every company writes in tnc – we can amend / change tnc anytime at our sole discretion .
btw for all see this -
http://www.snapdeal.com/page/terms-o...le
Clause of Pricing info -
3. Pricing Information
3.1 The Selling Price of the Product is subject to change without notice prior to the purchase of the Product by the Buyer. The Selling Price is provided on the Website on ‘as is’ basis as provided by the Seller. Due to technical reasons there may be errors in Selling Price which may be corrected by the Seller at any time and any acceptance of offer of sale by the Buyer of the Products subject to such faulty Selling Price shall, subject to discretion of the Seller, not be a valid acceptance and such transaction can be avoided by the Seller.
so these tnc comes under contract act , it is consumer forum which first listen consumers .
