Need urgent help please: Received an empty packet without phone inside

Hi Dimers,
I need urgent help. I had ordered nexus 5x 16 gb from amazon for 21999 and received the packet today.
I found that the packet contains only accessories and there is no phone inside. I called up cc and told them about the issue. After a long conversation the cc representative was ready to refund the money to me right away.
I want the phone but they say that the phone is not available with the seller. and the other sellers are selling it for 26499 which is 4499 rs higher than the price I have paid.
This is ridiculous. I need help from you all to help me in this issue. Please assist me the best thing I can do in this case. Thanks.

Duh! Just look at how she behaves even after explaining my position clearly. This is what I don’t like about women. Anyways once we took then call them up again try sue them and let them know that you can file a case in consumer court..they will have to get you the phone at the committed price..
but do this only once you received the refund from them.
